U.S. Marshals seize Madoff's penthouse

Bernard Madoff lost his Manhattan penthouse Thursday, when U.S. Marshals took possession of the US$7 million property and forced his wife to move out.

U.S. Marshals arrived at lunchtime, bringing a court order barring any current residents from staying and giving them control of the swanky living quarters that the disgraced financier lived in until last March.

U.S. Marshal Joseph Guccione said Madoff's wife had been made aware of what would happen on Thursday and would comply with the order.

"She will be leaving," Guccione said. "Restitution for the victims is the government's top priority."

Ruth Madoff was moving out and handing over all of her personal property, as part of a deal she made with federal prosecutors that allowed her to keep $2.5 million. But she could still lose the money if she is pursued by one of her husband's victims in a civil suit.

Her husband, however, has been in custody since March, when he pleaded guilty to charges that he bilked thousands of investors out of their money through a multibillion-dollar Ponzi scheme that lasted at least 20 years.

On Monday, he was sentenced to serve 150 years in prison for his crimes.

According to the U.S. Federal Bureau of Prisons website, Madoff is currently being held in New York's Metropolitan Correctional Center, an administrative facility holding pre-trial and holdover inmates.

On Monday, Ruth Madoff said her husband "stunned us all with his confession and is responsible for this terrible situation in which so many now find themselves."

I'd like to flash the BS card on this one. She is complicit in the scheme. If she gets to keep even one red cent, it would be an outrage to all those who lost everything.

$2.5M is a travesty! How about she be made to start over and make her money the way the rest of us do... WORK FOR IT!

The message here: conspire with your husband to rob people for 20 YEARS, and in the end you get to be a millionaire!

Very sad comment on the justice system. But then again, in the US you truely can buy justice.

That's not fair at all. She should be able to keep the penthouse and some of the proceeds of Bernies investment firm in order to live according to her lifestyle. The Feds are making her out to be a bad person. I am sure she is a wonderful woman. Stop picking on her!

She gets to keep $2.5 million because she "agreed to give up all her possessions"? Those possessions should have simply been seized ... period.

I hope their victims get every cent of that money in civil suits - while it's a paltry amount compared to what was stolen, the fact remains that she is not worthy of keeping it.

I feel Mr. Madoff is partially to blame for this Ponzi scheme. My opinion is that his investors are partially to blame as well, for constantly feeding this two headed dragon with billions of dollars, themselves being driven by greed and not once questioning how Mr. Madoff continued to bring in returns after experiencing smaller downturns of the US economy throughout the scheme's 20 year or so lifetime. I really have no sympathy for these individuals crying on CNN, how they now have to live on food stamps (you did this to yourself). Also shame on the US Securities and Exchange Commission for not following up on complaints against Madoff.

The question that must be asked is thus: Regardless of whether she knew of her husband's schemes or not, should she be allowed to continue living on what is obviously the proceeds of crime? If she is truly a victim as everyone else, kicking her out on the street, penniless, would simply be cruel. At the same time, 2.5 million seems to be excessive. 0.5, or even 1 million would probably have been more acceptable.

It's hard to believe she was not in on it. At the very least, she turned a blind eye to it all. If the DA is smart, He will trade considerable time off Madoff's sentence to recover the funds. If he gives back 95% - he should do only 5 years. The victims need their money more than they need Madoff in prison.

Drop the torches, axes and noose and prove her complicity and guilt first. He wasn't always a criminal, but within the last 15 years or so allowed himself to bet his life and integrity on a greedy scheme. Nobody, not even the mighty SEC or KPMG saw this coming. If she's guilty, she should go to prison as an accomplice. Otherwise, she should be left alone with enough money to sustain her. Guilt by association drive the justice system in the USA OR Canada.

She should be locked up like him. No mercy for the Ponzi & his family, investors put their trust in their hands now it's payback time with the lost in the billions while people are dead broke and bankrupted because of one family's greed.

Justice has not been done when criminals are awarded with invstors money.

Arrest her and put her through the legal system and be gone to jail.

Nothing in this story suggests she earned $2.5 million on her own, and since it's subject to lawsuits by her husband's investors, that pretty much proves it wasn't her money. Why should she get to keep a penny of victims' money? The court should immediately impound every penny pending the results of the lawsuits, so she doesn't spend or hide it.

I think that she had no idea of what he was doing all those years as the story reports he told his son just recently. I don't think she is being charged with anything is she?? So why should she be a street person because of all this. This is basically a retirement package for someone that stood by her man all these years. Should all murderers wifes be prosecuted too!!

Nice to see that they left a back door for civil suits. The lawyers will burn through anything she has left defending her from the sure to come civil suits from defrauded investors.

Hopefully she will have to leave the lavish lifestyle behind, hopefully she will even need to find a job. Good luck in the recession, but I'm sure she has an excellent resume.

@ Sherry: the lavish lifestyle she was living was funded by victems of her husbands crimes. If it were up to me she would be working in, and eating out of, a soup kitchen for the homeless until her husband is granted bail.

Ignorance is bliss, hopefully reality doesn't hit her too hard.

News Bulletin everyone: Ruth Madoff was NOT the one being tried in court. I suspect if the Fed's could have convicted her as well, they would have. It would have been extremely easy to hide this from wife and family, as any of you financially savvy types could attest to. In fact, the best kept secret is the one where you are the one who knows. If she is innocent,she has already been publicly humiliated and shamed. If not, it will come out. In the meantime, if she really IS innocent, she ought to consider, at the very least, taking a lie-detector test. There are some extremely reputable, highly professional companies out there that do this for a living and their results are usually correct.

Like most posters here, I find it very hard to believe Ruth M didn't know what Bernie was up to. For a little while, it might be possible to hide financial matters. But for 20 years?/ Give me a break! She knew! I like the idea, of her being ultimately forced to actually work for a living.

The vast majority of all those poor innocent investors got what they deserved.

Because they were blinded by their own greed supposedly getting a special deal from an exclusive investment guru they got burned by master con Bernie et al.

He and his family including Ruth, his wife, and inlaws, close friends and various other accomplices, soon to be exposed, ran a very smooth con that zapped the so-called victims.

I have NO DOUBT that the Madoff clan has been squirreling away funds and assets knowing full well this was coming down the pike. These people are crooks but they aren't totally stupid just half stupid for not realizing that crime doesn't pay....

What boggles my mind is how almost everyone here who has posted a comment seems so confident in something they are not involved in in the least. How do you know she knew what he was up to? For all of you out there who said that she must have know, you have no idea in the least whether she knew or not. Have you all never heard of a family where one spouse is hiding something from the other, whether it be gambling debts, another lover or excess money. It happens all the time, and a lot of the time you can argue that the other spouse should have known something was up, but they didn't for one reason or another. You can argue all day and night that she should have know, but the fact is nobody knows for sure, especially not the readers of a CTV web article. Mr Madoff has shown that he is the greatest con-man in history, if anyone can pull off hiding something from their wife for over 20 years it would be the man with that title to his name. She's innocent until proven guilty just like the rest of us would be, and besides, she's going to need most if not all of that $2.5 million to fight the huge lawsuit that is coming her way.
