Argentina legalizes gay marriage in historic vote

Following a long and tense debate among lawmakers, Argentina has joined Canada as one of a select few nations to legalize marriages between same-sex couples.

The ruling early Thursday makes Argentina the first country in Latin America to grant gays and lesbians all the legal rights, responsibilities and protections that marriage brings heterosexual couples.

Following more than 14 hours of heated debate during which thousands of Argentines protested outside the Congress, the vote in the upper house came down to 33-27 for the proposal, with three abstentions.

Since the lower house already approved the bill in May and President Cristina Fernandez is a strong supporter of gay marriage on human rights grounds, it's expected she'll sign the bill into law after her return from a state visit to China.

Opinion polls show a majority of Argentines support gay marriage, and many senators publicly states that they supported it, too.

"I believe this has advanced equal rights," Sen. Eugenio Artaza told reporters after the debate.

Sen. Juan Perez Alsina, who is usually a loyal supporter of the president, disagreed.

"Marriage between a man and a woman has existed for centuries, and is essential for the perpetuation of the species," he insisted.

The proposed law broadly declares that "marriage provides for the same requisites and effects independent of whether the contracting parties are of the same or different sex."

The approval came despite a concerted campaign by the Roman Catholic Church and evangelical groups, which drew 60,000 people to march on Congress.

Opponents, from children to elderly nuns, braved near-freezing temperatures to protest outside the Congress since Tuesday, snarling traffic in Buenos Aires.

The Senate's decision is sure to bring a wave of marriages by gays and lesbians who have increasingly found Buenos Aires to be more accepting than many other places in the region.

Same-sex civil unions -- not marriages -- had already been legal in Buenos Aires, as well as Uruguay and some states in Mexico and Brazil.

Mexico City has legalized gay marriage. And Colombia's constitutional court granted same-sex couples inheritance rights and allowed them to add their partners to health insurance plans.

With Thursday's decision, married gay couples can now adopt children and inherit wealth, which they couldn't do under same-sex unions.

Argentina is the first country in South America to legalize same-sex marriage nationwide.

Nine gay couples have already married in Argentina after persuading judges that Argentina's constitutional mandate of equality supports their marriage rights, but some of these marriages were later declared invalid.

Congrats Argentina!!! Whoever said the worlds' morality is evolving should slap him or herself and stick their head out of their butt. What are you talking about? Do you have something against comedians maybe? I understand south park and family can be a little excessive, but come' on laugh a little! An "open" society is a good thing. Taboos are akward and unnecessary. Human fear has always been a possible emotion, but the majority of todays' society really lives in fear. Whether it is the fear of being broke, losing your job, girlfriend, religion, obeisity or how you are perceived, etc...fear is fear. Knowledge is power as a lack of definition emits a lack of clarity. Heck, there are practically no real "gentlemen" left in this world. Remember how in the 1900-1950s how men acted towards women and in general with such courteousness, and look at our young adults now...They don't even take their sunglasses or hat off at the table. I hear everyone swearing excesively... You can either blame parenting, a high stress/inefficient society or our society slowly losing complelete control. Why fear a a gay? In fact, you should be less afraid!!!! :P

Prior to the extension of basic human rights to gays and lesbians, pretty much every day was heterosexual pride day. Basic human rights were only granted 15 years ago in Alberta and other parts of the country.
Prior to that homosexuality was marginalized completely. Even now, heterosexuality is flaunted all over our culture -- the majority of movies, music videos, books, and advertisements all endorse heterosexuality as the norm. I don't see heterosexuals working to stop parading their orientation in the general media. Nor do straight couples try to hide their orientation from others when they are out in public. Why should gays or lesbians?

Oh, and you think that there aren't already "heterosexual pride parades"? What do you think the long motorcades and big parties for heterosexual marriages are exactly?

In my entire life I never thought anyone should be denied "civil rights", because of the coulour of their skin,their religion,their sexual orientation, or anything eles that makes them an identifiable of defined group of people. However,I draw the line at marriage.It puzzles me when gays and lesbians say "it's not big deal,and I don't understend why heterosexuals are agaisnt this equality". To me,it smells more like politics than equal rights. If it really is "no big deal",then I suggest reversing the question and asking the gay and lesbian community why they are pushing so hard on this,and not considering alternatives.They could easily have all of the same rights as everyone on the planet,and live their lives happily ever after,as a united couple, but still leave the term "marriage" to those who believe it is a man -woman relationship.It would have been easy,and caused a lot less of a fuss if Chretien and his band of minions had lived up to their word when they announced.that "we will defend the traditional definition of marriage"..If they had,gaus and lesbians would still have equal rights,as they should.They would still be joined in matrimony,they would stil be living and loving as a couple.The only differences would be that the controversy and divions this debate is causing would have been avoided,and what are now gay/lesbian marriages would be referred to in another term.Maybe "civil union".Maybe something as similar as "gay marriage". So,they gay/lesbian community can hardly complain if tradionalists make a big deal over this,when they do the same thing themselves.Is it really a happily ever after union,and equal rights that they want,or is it something else? For my part,I really don't care.I just wonder why they couldn't also extend an olive branch to those with more traditional views.

Congratulations! Wonderful news that warms my heart. @Reddog there has actually been quite a bit of research on this topic ( not as much as could be possible if there were more grants directed this way-like in other areas) . The reports have found that children raised in Same sex families score higher on most standardized psychosocial measures of health ( meaning they are more adjusted and live more happily) . One suggested reason for this is because within the family structure the Gender roles are less rigid and so both parents are able to nurture more fully. Thank you for your concern for our world's children though. Be delighted in that the facts do not support that same sex family raised children are victims. It's actually the reverse.Once again, Congratulations Argentina! i wish you many riches in Gay tourist dollars and appreciate the support :P

And yes, pink money does not smell differently, so taxes should paid out equally in all countries.
Actually a next move worldwide, gay should get tax% brakes/refunds for the many years they paid taxes and did not have the right to share all the same benefits.

Those people here that are against this would have been the people years ago that were against interracial marriages, giving the vote to women and minorities. They argue that this is moral decline...I bed to differ.One really sad part it that they perpetuate the hate. Do they realize that if we did not allow same sex marriage then it stigmatizes and isolates an already marginalized group. I just wish that people would get over the fact that gay people exist, have always existed, and always will exist. No amount of hiding, excluding, or marginalizing will change this. In the end it's really about peaceful coexistence, right?

The religious right is desperately trying to make sense of their religion at the expense of a secular society. They will tell you the being gay is a CHOICE but it's an arguement full of holes. To even suggest that it's within each of us to be gay infers that it's within the person who would put such an argument forward. Being gay has not destroyed hetro marriages either and its been legalized here for many years now - another argument down the toilet. I suggest you read you own bibles which state that you need to stop judging others and spend all of your time preparing for your own judgement day.

Good for Argentina! I support gay/lesbian marriage. Pretty much all arguments against it can be blown out of the water with...(gasp)... logic! Live and let live, love and let love. Gay marriage is not going to erode society and morals any more than all the marital affairs etc. in our hetero population. And who's the idiot saying a kid raised by gays will become gay? Do you think everyone who is gay was grown in a tube?? Straight parents can have gay kids, so what does that tell you? And PRIDE week is now more of an inclusive event than ever. Sure, it may focus on gays/lesbians, but if you've ever been there, you'd know that the gay community just wants us all to be proud and happy with who we all are, and to love who we love. So get over it and get happy! :P

And by the way, the notion that children raised by homosexuals are more likely to be gay themselves is absolute nonsense. The reason for homosexuality has to do with the environment in the womb. At a critical point, the brain receives a dose of androgens (if it's male) which sexualizes the brain to be straight. If it's female and receives those same androgens, the baby is likely to be a lesbian. If it's male and doesn't receive the androgens, it's likely to be a gay male. There is no evidence-none- that anyone can "choose" his or her sexuality any more than one can "choose" his race. Kids brought up by gay couples turn out to be gay in exactly the same proportion as those raised by straight couples. And some studies show tkids are better adjusted when raised by gay couples, because they are less homophobic. Homophobia isn't just a belief- it's a kind of pathology driven by fear and hatred, and is bad for the mental health of the individual involved. It's no different than hating black people, or jews. Not suprisingly, we find that same group of pathologies mostly in right-wing people. Being right wing may not just be a belief- it may be a kind of character defect.

This is fantastic news, and a sign that times are changing for the better. I guess the people who oppose this will always have their say, but they are beginning to become the minority, and I couldn't be more pleased about that. Marrige isn't about responsibility, or law it's about caring for someone and wanting to be with them. It's true to say that marriage is essential for raising children, but it is logically false to then argue that raising children is the only purpose for marriage. If that were true, then sterile people shouldn't marry. If that were true, then people who don't want kids shouldn't marry either.Should people over 50 not be allowed to marry because they won't have children? Marriage isn't just about kids, Alex. It;s also about the desire of two peope to form a loving relationship that will sustain them throughout their lives. So what difference does it make what the race or gender of the peope involve is? Why should it matter to the rest of us what the two men or two women down the street are doing in their bedrooms? There is no logical reason to oppose gay marriage, and lots of ethical reasons to support it . We have allowed gay marraige here in Canada for the past 5 years or so- and what "disasters" have occurred because of it? Can you name one thing that has impacted anyone's lives in a negative fashion? It has certainly improved life for gay people, and why should that be a bad thing?.

As Argentina becomes progressive, our Canadian Conservative government becomes more regressive; acouple of examples: pulling funds from the Pride Parade in Toronto and also calling a second vote on gay marriage after it was already decided by Parliament. Argentine politicians are the first in Latin America to realize that backing gay marriage attracts votes (instead of repelling them, as it usually did). Society is changing for the better and hypocrysy is slowly losing ground. Here, in neighbouring Brazil, I'm in tears of pure joy as I haven't been for ages! What a fight it's been to see this moment...Now, for those who claim homosexuality is wrong... Well... what's wrong with you, people? Condemning gays these days can only be related to people who believe in Creation instead of Darwin, or being a closeted gay or something (or being afraid your sacred husband/wife may divorce and remarry a gay partner). May God take good care of your children's minds... It must be hard on them to have parents still living with Inquisition-time morals...

From Argentina, I want to thank all the encouraging and nice posts. As country, we have endured terrible atrocities, and as our President clearly stated, this is an expansion of human rights. We are creating a society where everybody has equal rights. Period.
To the ones speaking about Argentine economy, they should read more thoroughly. Argentina has reduced its foreign debt, has declining unemployment rates, and has had for 8 consecutives years twin surplus (fiscal and trade). Our federal reserves have doubled. Our President is in China signing a historical agreement with that country.

Another country in moral decline. In our day and age, we've gotten so obsessed with rights and freedoms (which aren't intrinsically bad) that we've gone too far. We've made the mistake of thinking that marriage is a right, when in fact it's a responsibility. Marriage is the most fundamental institution of society (and always has been), and we have in order to control the romantic love we have for each other and therefore raise our children properly. Marriage is only partly for the good of the spouses; it's also meant for the good of the children (this is why it's a mistake to think of marriage as a right in the same way as, say, the right to education or free assembly). If same-sex "marriage" is allowed, marriage loses its meaning because these "couples" can't have children; and if they adopt, the children aren't being raised in a proper environment. By changing the definition of marriage, we are messing around with society's fundamental institution. It's frightening, and we don't have the right to do it.

I agreed in having gay marriage, but I don't agree in allowing gay couple adopting young children. The law in Canada must put more restrictions regarding adoptions.

When a young child grows in a gay environment, they are going to do the same. Nobody wants to do any studies for the future children whose were adopted by guy couple.

If we have a need in getting more people to adopt children, why the Government allowed gays to adopt young children instead of teens (over 12 years). Chances are that teens have their sex more defined.

This decision has nothing to do with "bedroom sexuality". This is about equality in rights. What makes a man and a woman's commitment to spend the rest of their lives together from two men or two women? Nothing. As for children's rights to be raised in "normal" homes, please. Children deserve love from everyone in their household. This issues is the same as Blacks getting rights in the 60s. I wonder how many of you that are against gay equality rights were the same ones against racial equality rights.

@It's a Moral Issue: Save distortion and exaggeration for your church sermons. A 'hate crime' is only perpetrated when someone commits an act of violence based on discrimination, and if you knew the alarming statistics (including my own -- where I wasn't flaunting anything, I might add) you might be a bit more compassionate. But no, of course you wouldn't, because by the the tone of your post it is clear that in your opinion gays and lesbians are categorically immoral; never mind all the homosexual teachers, artists, philanthropists and clergy who do good works in this fragile, hate-filled world of ours. In arguing for your "right to sexuality" you have taken away my right to say you are wrong. I am not afraid to argue my position, but you are. The laws that have been put into place charge me with hate crimes if I say anything against you in public, but you can call me names, ridicule me in public, have gross public nudity parades and flaunt your lifestyle in my face, but if I was to speak a word against you, I am in the courts. Good. I can't see why my relationship with my boyfriend is any less than valid than those of all my straight friends. It always baffles me why some people are so against gay marriage. If you're straight and happy with your husband / wife, why should you care who other people choose to live their (our) lives with?


Evolving morality has no end
said

Legalizing something doesn't make it morally right, it just means the state has abdicated its responsibility to uphold a certain ethic. The state has legalized abortion for example. To make marriage "legal" for homosexuals is not about "human rights" it is about letting people do what they want, and it is saying that when it comes to this area of society, as a government, we do not want to be bothered policing it anymore. So where do we draw the line and what foundation does the institution of marriage stand upon? I will readily agree that society's morality is "evolving" but what is it evolving into? Simply put "everyone is let to do what is right in their own eyes" when there is no king [i.e. when there is no standard of morality]. Now the floodgates are open for polygamy, for young age marriages without parental consent, etc; we have made an institution meaningless by allowing it to be so commonly used. Even the Greek and Roman cultures of long ago, wholly accepting of homosexuality, saw homosexual marriage "unnatural" - and always used different terminology to decribe the union. But we contend "our society is more enlightened than theirs."

Good for you Argentina and many latin states. Funny how the USA and the Catholic church - supposed stalwarts of freedom and human rights both fight this tooth and nail. shame on the pope and the church .. shame shame shame on Obama ... being black one would think he supported other minorities

If this is OK, what's wrong with a little polygamy for consenting adults? Much easier to raise children with many hands on-board.I think this ruling sucks, not stuff I'd teach my children was proper and healthy for the human race or as individuals. Please feel free to do what you like in your bedrooms but keep some clothes on in public please. Children are watching.
