Tory minister says flag law won't apply to MPs

OTTAWA — The Maple Leaf may be forever, but it isn't for everyone.

A proposed new Conservative law that enforces Canadians' right to fly the flag won't apply to MPs on Parliament Hill, Heritage Minister James Moore said Wednesday.

A private member's bill, backed by Moore, would make it illegal to stop someone from displaying the Maple Leaf.

The bill addresses a minor irritant that primarily involves condominium owners and apartment dwellers, where signed contracts may forbid hanging items such as flags, flower baskets and satellite dishes outside the building.

Condo boards and building owners, on penalty of jail time, would no longer be able to enforce such rules against nationalist flag-wavers if the legislation is passed.

But what's good for the Canadian goose is not necessarily good for the parliamentary gander, Moore said when asked about rules forbidding MPs from having a flag in the window of their parliamentary offices.

"It's a consensus that all parties will operate on a standard within the parliamentary precinct and MPs can choose to -- obviously have a responsibility to -- abide by the rules that we mutually agree to," Moore said following a Conservative caucus meeting.

Asked specifically if the proposed law will apply to MPs, Moore said "No."

"Members of Parliament voluntarily agree to the Board of Internal Economy consensus on how we should operate on the Hill. We choose to do that ourselves."

But, asked a reporter, don't condo owners voluntarily agree to the rules of the condo?

At this, Moore raised the white flag and beat a hasty retreat from the scrum without a response.

The legislation was proposed by Ontario backbench Tory John Carmichael and would impose punishments including restraining orders, injunctions, a fine or jail sentences of up to two years.

When he introduced the bill with Moore, Carmichael acknowledged that condominium owners can arrange their affairs any way they choose.

"But I don't think Canadians' right to display the Canadian flag should be stepped on by Canadians who feel otherwise," said Carmichael.

Since winning a majority mandate in May, the Harper Conservatives have made a point of highlighting a number of traditional Canadian symbols.

That has included restoring the "royal" designation to the air force and navy, directing that the Queen's portrait be hung in Canada's foreign missions and promoting various historical events from the country's past, including the War of 1812.

Why is our federal government fumbling around with condo owner problems? This is at best a municpal issue. Utter waste of time and energy by the feds. And I'm a Con supporter, so this bugs me even more. Attention Harper: you were elected to cut debt, cut spending and create jobs. Not to blow political smoke up our balconys.

I’m curious to know if a dual citizen could fly Canadian and Israeli flag side by side from his/her window? Maybe Mr. Baird and Prof. Pye Chartt who are expert in these issues (and many other issues) could answer this question.

I have seen many proud Canadians with their Canadian Flag, Hockey Flags flapping on the windows of their vehicles..just wondering if this will change also..hmmmmm.

Perhaps it is time for Canada to have the oath of allegiance repeated daily, to get people to think about their nation more instead of just Me, Me, Me. Individual rights are fine, but the group rights of the nation are just as important, and that includes supporting our national institutions and symbols, notably the flag. Judging by all the negative comments here, I am led to believe that some people would rather be anywhere but in Canada, and have no national feeling at all; it's all about them and to H*** with anyone else. As for MP's not having flags flown from their windows: there is a Canadian flag flown on, or in front of, every federal building, so individual ones are unnecessary.

Jason - OK - So what about the Cons. mantra that they want to get government out of people's lives? Pushing forward time/effort wasting bills like this seems to fly in the face of their stated objectives. Deal with jobs, the economy, trade, human rights... and leave the petty stuff alone.

Umm, there is already a flag flying on the Parliament Buildings and government offices in downtown Ottowa... doubt we really need to see them flying from every office window... besides, an office isn't owned by the MP, its only there for his use... It would be like me going to work at Tim Horton's and hanging the flag out the takeout window - not my property to be doing anything to it.... A condo is a private home, not a place of business owned by someone else.

I think the government should stay out of my condo association and our rules... If someone doesn't like the rules of our condo, they can choose to live in a different complex or they can choose to live by the majority rules of the condo complex... What is next, they will come into my bedroom and tell me what is right and what is wrong? Feds can stay away from my home!!! And laws that are good for me are laws that are good MP's. The fact is that they didn't agree to obey by the rules of Parliament, they were VOTED by the people to represent them!!!

Because of this - I am now specifically going to write it into all my future tenancy agreements that flying any flag from my property is forbidden and I will enforce it. It's not about the flag it's about freedom. If the facist Conservatives want to send me to prison for upholding my private property rights they can try. If Canada is going to become a nation where state-sponsored nationalist frenzy trumps the rights of individuals who work for and pay for their private property rights then we are all a lot worse off. This is not Mussolini's Italy or Franco's Spain. It's Canada.

there is a difference between flying flags on condo's homes, business' and Parliament ....this is 'nit-picking' to the enth degree - a non issue ..Parliament is what i would call " sacred" territory - higher standards and rules apply . . . - despite the fact that we have multicultural backgrounds of our MPs and Senators - despite the fact we have MPs from all parts of the country, and despite the fact we have members with a separatist agenda - we are one on the Hill - Canadian ... one flag is all that is needed/required on Parliament Hill .. and that is the maple leaf flag on the Peace Tower and any other specifically designated locations ... not a free-for-all in every MP office window..

Well, here's a good law. I don't know why any body would want to restrict displaying our national symbol. I think we, as Canadians, should start feeling better about our country as a whole, as opposed to whining over every tiny detail. This is what laws should be made of. More freedom, less restriction.

I have tried to read the dribble of most of the comments and have come to a conclusion that they are written by non working, taxpayer sucking persons. This flag, which most Canadians are proud of, should have some distinction and Canadians should have the right to display it.

This new law is stupid. The conservatives don't realise they aren't any more special than the rest of us and if a law applies to "us" it applies to "them" as well. The law is the law for one and all. I'd like to know what other exemptions they think they're entitled to. They seem to be living under the illusion that we are here to serve them (flying free in jets) when in fact they are here to serve us.

Once again, the media trying to make a mountain out of a mole hill. I wholeheartly agree that Canadians should be able to fly a Canadian flag in an appropriate way even if they live in a condo or townhouse complex, and especially on Canada Day, when some people have been stopped from doing so. Parliament Hill is not a residence, and it appears they already have their own rules in place. I hope the bill passes, however, I don't think anyone will be serving jail time for an infraction, nor should they, but it will give homeowners the chance to show their patriotism without getting harassed by their Strata. What can be wrong with that????

So far its been exclusively a steady diet of draconian laws aimed at imprisoning as many Canadians as possible.
I guess you have to fill those new prison cells somehow,eh?

The contract sign between a condo tenant and landlord is a private matter. It is not the government business to dictate what can or cannot done on a private property. If so, then why MP should be exempt from this stupid proposed law.

Hey Will,,,, wake up, read the intent of what’s being talked about. Yes, house of commons is not a condo unit, but as an MP in the parliament buildings, if i want to hang a flag showing my passion for this country, I should not be stifled by the regressive conservatives how hate the color RED….. does it make sense, yes, but really, jail time???? All buildings in Canada should be able to display the flag, as long as it does not pose a safety hazard....

It's slowly coming together, it you don't read the instructions on the new flag hanging web site & you hang your flag wrong you face up two years in prison. Harper's really trying hard to make enough stupid laws to fill those new prisons. Condo dwellers sign a contract agreeing not to hang flags in their window & balconies. The conservatives want to step in the way of business once again & impose their stupid laws.

The regressive conservatives are at it again, trying to drum up support by displaying icons, seems a very American conservative kind of thing they are doing, and just to make it doubly sweet they won't apply their own laws to themselves, so much for less government!As the old saying goes: "Patriotism is the refuge of a scoundrel."

So a reporter tried to set up the MP with a trick question and he wouldn't play. How is this news? Let me educate the reporter(s). The House of Commons is NOT a condo, it is the seat of government for Canada. If you can't see the difference, you don't deserve to have a job reporting the news. As it is, your conduct calls into question your ability to correctly perform the duties of your position, your impartiality is in doubt. "Have YOU stopped beating your wife?"

Again it seems there are laws for us and other ones for MP's Yes this is so trivial but the press wants to imbelish and get out goats. I want to see referendums so the people can vote the changes this county and stop our morals being dictated by any of the parties wills. A note was made by a NDP MPP and the part that got me was "I can't raise my children in this type of rules yet she accepts lying, deciving, stealing and silly name calling. I can't except our Politicians endorsing lying and stealing and even to the point of "well that's the world we live in" No that's the world politicians have created. We must take it back from them.
