Real estate board sidestepping concerns: watchdog

OTTAWA — The federal competition watchdog says Canada's largest real estate board is falsely citing privacy concerns to deflect attention from its allegedly anti-competitive rules on the use of password-protected websites.

The Competition Bureau accuses the Toronto Real Estate Board of sidestepping its concerns about stifling innovation and competition in an updated policy on what are known as Virtual Office Websites, or VOWs.

The comments were made in a reply Friday to TREB's submission filed with the quasi-judicial Competition Tribunal, in which it claimed privacy laws would be jeopardized if it opened up its database to online access.

The bureau initially filed a lawsuit against the board in May, alleging that consumers were being denied choice because local agents are banned from giving consumers direct access to information through websites.

TREB has since updated its policy on VOWs, but the bureau says the policy still prevents consumers from accessing valuable data online that is available to agents through its Multiple Listing Service.

The board's new policy still insists that consumers receive that information by hand, mail, fax or email from their agent, but the bureau says it will not quit until TREB's rules apply to all business models.

TREB is no different then the Oil Cartel. All the local realtors (who should be competing against each other) are quietly and secretly consipiring behind closed doors. This is especially bad, because they are artificially forcing the price of a house upwards strategically. Why? So they can take a larger % commission on the sale. They do not have your best interests, and they are not accountable to anyone or anything. At the same time by restricting information, they are forcing "the private seller/buyer" competition out of the real estate markert. See Wiki Anti-Trust laws.

TERB is a private organization run by real estate companies. There is no law that says that you have to use a real estate agent or anything associated with TERB to buy or sell a home. If you don’t want to use them you can sell your house privately. Why should they be forced to open up the systems and processes that they developed at their expense to anyone?

Everyone is missing the Point. Toronto real Estate Board and MLS are private corporations owned by the realtors....I do not see the watch dog go after the Banks, Oil companies, telephone companies,car company, etc. the same way...We as realtors have invested Millions of dollars in our system..Why would we give this up...this is ours and it is part of our services offered...the sale ifnormation is available to the public on GEOwarehouse--for a price.....

Because the majority act in the best interest of themselves and don't fully disclose facts about houses we are trying to purchase. They have conversations behind closed doors with other agents and are insanely unethical. The only thing worse than a lawyer is a real estate agent. At least a Lawyer is educated. Lets see what happens to real estate fees when competition is permitted. Hell on an average 300,000 house the agent is making more than the lawyer. Get Real .

Same problem in Vancouver! Buyers do not have access to the website showing price sold for similar units for example. This is publicly available on the City of Vancouver website for the 3 month period of home taxes evaluations. After that, must go through an agent to get the info. This should be public information all year round, not only 3 months of the year! No need to bother an agent to get this type of information. An agent is useful for help in finding buyers or sellers and dealing with the paperwork. Anyone is able to check a price list online without babysitting!

Maybe the Competition Bureau should check up on the oil companies. Here in BC the price of gas jumped 11 cents per litre in a matter of hours, then dropped 11 cents per litre the following day. This was at all service stations, even the so called discount stations.It appears there is no competition here!
