Former parliamentarian Helena Guergis broke conflict-of-interest rules when she sent a letter to municipal politicians in her riding in 2009, the federal ethics watchdog concludes in a new report.

Guergis was the Member of Parliament for the Ontario riding of Simcoe-Grey for nearly seven years, until her defeat in the recent election.

In September 2009, Guergis wrote a letter to the warden and council of Simcoe County, asking that they consider a proposal from a local businessman who owned a green technology company.

The businessman, Jim Wright, was hoping to pitch a waste-management project to the Simcoe County council.

At the same time, Wright had also been talking about potential future business opportunities with Rahim Jaffer, who is married to Guergis.

Guergis claims that Wright and her husband both indicated they were no longer in talks before she wrote the letter.

But an investigation by Conflict of Interest and Ethics Commissioner Mary Dawson has found that the two parties were in communication with one another when she sent the correspondence to the Simcoe County council.

"I determined that Mr. Jaffer was building a business relationship with Mr. Wright during the period when Ms. Guergis prepared and sent the letter to Simcoe County officials," Dawson writes in her final report, which was released on Thursday.

"I also found that Mr. Jaffer had a private interest in relation to the letter, as the work that he did relating to Mr. Wright, Wright Tech and its related marketing firm, Green Rite Solutions Inc., was carried out in the expectation that Mr. Jaffer would at some point receive a financial benefit."

As a result, Dawson has concluded that Guergis violated two sections of the Conflict of Interest Code for Members of Parliament -- one of which prohibits parliamentarians from acting in any way that would benefit themselves or their family members and another that bans MPs from influencing the decisions of others to achieve the same ends.

"Ms. Guergis was aware of some of the initial business interactions between her husband and Mr. Wright and his companies that raised conflict of interest concerns and therefore she should not have written the letter," Dawson writes.

Dawson formally launched her inquiry in June of last year, after completing a preliminary investigation.

Neither Guergis nor Jaffer hold a seat in Parliament any longer.

The 42-year-old Guergis ran as an independent in the recent election, losing her seat to rookie Conservative MP Kellie Leitch.

Prior to being expelled from the Conservative caucus in April of last year, Guergis had served as a junior minister in Prime Minister Stephen Harper's government.

Jaffer, 39, served as the MP for the Alberta riding of Edmonton-Strathcona for 11 years. He was defeated in the October 2008 federal election and did not run for Parliament again.

Guergis and Jaffer have a young son, who was born last December.

I can’t believe some of the opposition and their supporters. First they demand she resign she will not, and the PM kicks her out of the party. The opposition cry fowl and say that the PM was too mean. Now the truth comes out that she did do wrong doing and the PM was justified to kick her out and they are still not happy. Is that all she did? Unethical maybe. Criminal not. Jean Chretien and Brian Mulroney could give her some pointers. There's not enough space on this forum to list the capers they were "alleged" to to be involved in. I recall stuff about big dollar gov't business loans to friends and payoffs for airplane sales. Her only real mistake from everyone's point of view but hers was hooking up with with the wrong guy.

To the opposition and media -- I think it's safe to say our PM is truly wise. First, the media hounded Guergis and called for her resignation. Harper then booted her from caucus. THEN, the opposition claimed Harper was being sexist for kicking a woman out. The TRUTH is finally out -- our PM knows what he's doing!

@catwoman -the RCMP and the Ethics Commissioner examine the case in different ways. While the RCMP found that Ms. Guergis didn't break the law, the Commissioner found that her actions were, in fact, unethical.

Little wonder we get what we deserve from politicians as most people with impeccable integrity and character wouldn't bother to submit their name in the ring and allow their good name to be dragged through these social media bloodhounds who usually don't have a hot clue what they are talking about or the &%$@ to say to your face what they so willingly put in print while hiding behind anonymity. Nobody deserves the kind of public thrashing seen here daily.

Knew that it had to be something that wasn't within the code of being an MP...too bad to make a spectacle of yourself crying on the NEWS and saying I was cleared of all wrong doing...not sure what she was talking about there..but obviously the commissioner should have come out with this long and before she decided to run again to at least save her the embarrassment of it all. Stay home and be a "mom" that's why many have children and one would think you could afford to be one who could stay home....send Daddy Mom back to work....

Is this where one or two of the rabid anti-Conservative "groundhogs" (a crabby armchair politico who pops his/her head up from a hole only to comment on CTV stories having to do with the federal Tories) tables a non-witty condemnation? I seem to recall certain Liberal types (including the humiliated former leader of the party itself), for example, chastising PM Harper for being "unfair" to Ms. Guergis. The letter in question was revealed publicly in the beginning, and the perceived conflict pointed out in the media. PM Harper and his Conservatives, obviously, did the right thing. Kindly pop your head back into the hole, friends, and save your waywardly unbridled contempt for another time. (Don't fret; there'll be another opportunity.) Thanks.

Although I must say it is nice for someone in the government to finally pay for their actions I do feel that this example is pretty petty! Its a shame those responsible for larger unethical business practices are not hung out to dry.

Yeah, we all knew there was something that made Harper toss her out and as always, the truth always comes to the surface. If he had not have done that, she may have become a liability during the last election campaign. Well, I hope she's enjoying her life back in the private sector with new little family.
