A Saskatchewan man convicted of killing his daughter's drug-addicted boyfriend apologized for the crime in court, but the victim's family rejected his apology.

Kim Walker was found guilty of manslaughter Thursday for killing 24-year-old James Hayward. It's was the second time Walker has stood trial for Hayward's death.

A sentencing hearing on Friday included a victim impact statement from Hayward's brother, Dan.

"You will never fully understand what you have done and I will never forgive you for it," the statement said.

Hayward was "a 24-year-old man with problems, someone that made mistakes, just as many other people do in life," his brother said. "He never got the chance to straighten his life out because Kim Walker stole that chance from him."

Justice Ellen Gunn said she will decide on Walker's sentence July 13.

The court heard that Walker's then-15-year-old daughter Jadah had become addicted to morphine under the influence of Hayward, and that Walker had received death threats from the boyfriend.

In March 2003, Walker had obtained a warrant that committed Jadah to hospital for 72 hours of addiction treatment, but she was living with Hayward.

Walker brought a 9-millimetre pistol to Hayward's home. According to Walker's lawyer, it was for protection.

The court heard that Walker fired 10 shots at Hayward, hitting him five times. Hayward, who was unarmed, bled to death.

Walker was initially convicted of second-degree murder in 2007, with the jury recommending he be eligible for parole after 11 years -- the most lenient possible sentence.

But that conviction was appealed and successfully overturned last summer, because the trial judge, Justice Jennifer Pritchard, had met with Crown and defence lawyers at the same time, off the record, without Walker present.

Father tries to protect a member of his family and our justice system condemns him for it. He will now spend years in jail for doing what a father should have the right to do. So When looking for Justice do not depend on our legal system to be fair or for that mater "proactive".When our public legal system has a superiority attitude, lack of accountability, acts as if itself is above the laws of the land and being so expensive to the average citizen they cannot afford to see this so called justice, I think we have a problem that cannot be fixed from within.

Kim does not deserve prison for doing the world a service. Our justice system is so lax its no wonder criminals flock to our country and drug dealers ,organized crime, drunk drivers and rapists ect... will continue because they know even if caught they dont have much to worry about in our nice comfy prisons where they live better than people on income assistance.

I have two young daughters, and I am wondering how a 15-year-old was ever allowed to move out on her own in the first place - nevermind to live with a 24 year old man! I completely understand the parental instinct to protect, however, it seems as if this was a bandaid for something that should have been addressed much earlier - and a bloody mess of a bandaid at that!

I agree in principle with the allowance of letting citizens remove drug dealers from the community, but the use of force should be constricted to an action that simulates the actions that police should be using, which is arrrest and conviction. All citizens of our country should be made aware of the provisions of a citizen's arrrest. It must however be accompanied by evidence that can be used in court. This man did a heroic thihg obviously, giving up years of his life which will be spent in confinement to save his daughters well being. I just wish he could have done it in the confines of the law. Now, Mr. Harper, is there any way that you can examine such cases, and enhance our citizens' rights in a way that makes it possible to give our citizens that want to make a difference more strategic efficiency? Pullleeeez do.

Kim Walker, saved Jadah's life - she is now a contributing member of society, who is married with a child. However, what he also did was save the lives of many of my classmates who, at the time had also been sucked in by Hayward. Hayward was not only shooting these kids up with morphine and God knows what else, but he was also using the girls to make elicit videos. Kim Walker is a hero. James Hayward essentially got what was coming to him.

It is absurd to say this man did the right thing. Irregardless of the age between his daughter and the boyfriend, irregardless of the drug addictions, he he committed cold-blooded murder. Period. He is not a hero, he is a murderer.Had he called the police they would have intervened, they would have removed the daughter from the home- safely and the now dead boyfriend would have been charged for statutory rape of a minor, and would have been the one facing charges and possibly jailed. Instead he took the law into his own hands and he committed the ultimate sin and he intentionally killed someone.It was not in self-defence, it was simply an angry father, deeply concerned and disturbed for his teenage daughter who took the law into his own hands rather than have the Police step in. And that is inexcusable in today's society.

It is a disgusting real life drama for sure. After reading the posts here I could only think what my course of action being as I have experienced an episode of insanity on my 15 year old daughter's part. My first course of action would be to contact the police as it already had criminality built into the equation. She was a minor. My first reaction would not be to get a gun and kill another human being, as we are in an age that we should have long ago stopped solving our problems with violence, but I was not Walker or in his state of mind.

Whether you know it or not, when you child is born, you take an oath to do "whatever, whenever, however". As a father, I have no problem whatsoever with what Mr Walker did, and if found in similiar circumstances wherein the capacity or the consideration of the law was insufficient, believe that all parents should take similiar steps to protect their child.The world would be a much better place if parents lived up to that oath, regardless of whether society and/or the law approves of the action required to do so.

Above all else, the duty of every father is to love and protect his child(ren).I have teenage daughters of my own, and for a while one of them was dating a scumbag not so different from Hayward. My daughter went from a happy, vibrant, life-lover to dark, disturbed, and suicidal in a matter of a few months. I did everything in my power to stop him, and thankfully I was able to catch him in his manipulation and prove it to my daughter - she dumped him and has returned to her previously happy self.That being said, I did not have to go as far as killing. But only a father who truly loves his children understands that there are no limits to how far a father will go to protect them - especially daughters. We do not fear consequences and we will give up our lives.Kudos to Walker - he may have broken the law but he was being a great dad. Hopefully the courts understand that.

I would like to congratulate the Canadian Justice system for getting it right this time ....... look around we are raising our younger generations to think a anything goes attitude is okay and crime is just a system of not giving all social workers a raise the any time their public sector union threatens a strike.It all starts at home this man felt powerless and I wholly believe he was justified in his actions.

Mr. Walker did the right thing. It i a father's obligation to protect their children by whatever means neccessary. Besides that, the guy must have been a total loser being 24 and living with a 15 year old child. One less drugged out welfare case leach that we have to pay for. I hope Mr. Walker appeals this ruling and the court applies some common sense to the judgement. The man's actions clearly don't require jail time.

This is what happens when one takes the law into one's own hands. The law had to deal with Mr. Hayward, not Mr. Walker [to the extent of murder]. While understandable [I write as the father of two wee girls] Mr. Walker has now to pay the price for his precipitate actions. I wonder what has happened since to that girl.

Justice has been served! If more people topk actions like this there would be less scumbags and drugs on our streets and our children would be safer! Any father would have reacted that way and more should. With our justice system what would he have got for enticing, etc.. this minor? NOTHING!!.

Where is Dexter when you need him. If his daughter was living with this drug addict at 15 I doubt this will end her problems. What happened to her? I guess her father just could not take what was happening to his daughter anymore, and god knows the police aren't much help in these situations. They should live in Ontario, killings in the street or school hallways and they get away with it here.

At the end of the day Hayward was still someone's son, someone's grandson, a person that others loved. Walker may have been trying to protect his daughter, but he shot someone who was unarmed, meaning Hayward was really not that large of a threat to him. He murdered a man, a man whom just like his daughter needed help to get out of the lifestyle he was living. To call someone a hero for taking another life for no justified reason is sickening. There are other, much better, ways of dealing with a situation like this. This man is not a hero, and deserves everything that is coming to him.

what's wrong at home that a 15 year old girl wanted to escape her parents that much, plus do serious drugs? good kids are raised and molded at home. you need to give kids the tools to make the right choices.

How many other young lives did this guy affect before he received the ultimate sentence?The father did what he thought he had to do in order to save his daughter from a possible death due to a drug overdose.Although he murdered this drug dealer, I sincerely hope that he gets the minimum sentence possible.

As soon as this scumbag threatened Walker and his family, he was well within his rights to protect his family. I know Kim should not have gone over to the Boyfriends place with a gun, but again if legitimate threats were levied, all bets are off. A manslaughter conviction is a price I would personally be willing to pay for my family's security, every time.

There's a drug dealer next door. The police have been called many times by my neighbours and I. I've actually have an open file number to call in to. The family has 4 newer vehicles, all plated. The son (drug dealer) has no job, drives a Chrysler 300 (washed every time it gets dirty). Mother works at a low income job (no grip against her, partly deaf) and live in a low income housing house. NO wonder we shake our heads at the society that has risen out of drugs. I have three daughters and I would have done the same thing and STILL MIGHT. He's a hero.

This man was protecting his family from the possible hellish life that he could see they were heading towards because of the drugs his daughter was becoming addicted to. As a father of a little girl (and boy, let's not forget they can get caught in these webs too) I know I would do whatever I can to protect my kids and family. My only concern with this is that it might set a precedent for other parents to go off the deep end and attack their kids' friends or boy/girlfriends and rationalize it that they were doing the exact same thing that Kim Walker did. Some of it might be justifiable, but I would guess that others would use the excuse because they simply don't like who their kids are hanging with.

Right or wrong, he killed a guy which as you all know is against the law.I can see his point in doing what he did (I would have done the same thing), but he has to be punished for killing someone.Does anybody know how his daughter is doing know?

Dad did the right thing by taking care of his daughter but at the end he killed a human being. He is guilty. I don't belive he should get a long sentence since he is unlikely to reoffend. We've seen worse cases with people getting off with a much ligther sentence.

He's not a 'hero', he broke the law...but, he's a good parent and he did the right thing by protecting his daughter. He knew the consequenses of his actions and knew right from wrong and yet he still believed that protecting his daughter was paramount. Though the victim was a drug addict and shouldn't have been hunted down and shot, even though he made some very bad choices. Having said that, the convicted in this case was trying to protect family not rob a gas station or something of that nature, he should not get any heavier sentence than was first given, PERIOD. I think the greater issue/problem here is the crown prosecutors, judges, cops and those we have elected to serve society's best interest are failing us at almost every turn they make, the system is profoundly flawed and rip with corruption, time to clean it up, started from the top down. We really have to be more careful who we elect, they start the mess... Harper for example, thanks to redneck Canada, will have us all in prison by the end of his next 4 years and martial law declared on the streets of Canada. However, he is just one among the many poorly elected we have been putting into power for a very long time to create the corrupt justice system we now have. The Crown prosecutors, judge/s and if involved in this case yet, cops should be told in no un-certain terms to leave this man alone or they will be fired and charged them selves with obstructing justice. It is time we took back our justice system from these wild cards/abusers of the law/s.

How is his daughter doing today?God bless him for caring enough to recognize that the wrong thing to do can sometimes be the right thing as well. Seems like the whole thing could have been solved by the justice system long before he acted.

We have police if someone feels threatened by someone and he could have called the police to help him get his daughter for rehab. He chose the gun. He shot a 24 yr old who was unarmed - someone who was clearly on the wrong track but he had no right to shoot him. We can't all go around shooting people because they're morons. If the police did this everyone would be crying out saying it was wrong.

OK, I 'get' that we can't just go around killing people. I also 'get' that this guy was determined to do what was best for his daughter - but I've really got to wonder how on earth his FIFTEEN year old daughter ended up living with her TWENTY-FOUR year old boyfriend? Kim Walker did the right thing. As an 19 year old, I would appreciate that my dad would look after me. Yes, his daughter was only 15 but the point still stands. He did what was right. Would you rather have a drug addict daughter, knowing you could have stopped her . . Or prevent it from happening. From experience i'd rather have a non-druggy in my family. He did the right thing.

Manslaughter senteces generally rund around 7 to 10 years. With the time he has already served he will probably be out of jail sooner rather than later.Killing the scum bag was extreme but as a dad of two daughters I understand his motivation. I don't mourn the drug dealer at all. He go what so often happens in the underworld he crawled in. He's not ruining any more lives where he is now.

This just goes to show you how the legal system differs from a real justice system. Canada needs more men just like this guy. He's a hero, not a criminal regardless of what the law thinks. He saved his daughters life, and I hope he's proud of that fact. Hopefully this is a lesson to wannabe gangster thugs everywhere.

Kim Walker is NOT a hero and should be found guilty. He murdered someone who was unarmed. His daughter was not a saint and was into trouble before meeting James. James needed help to get off of drugs too. You people who call Kim Walker a hero need to shake your heads!!! Shame on you.

Like most people before me I can't believe our system will allow criminals to get off with warning after warning. Mr Walker did exactly what I would have done, and even after this conviction would still do today. How could a jury not have a reasonable doubt in this case. He was protecting his daughter from a person who cared less about the laws or in all likelihood this girl. This is sad and something must be done. This man cannot go to jail for protecting his own daughter from further harm or death.

I sincerely hope this trial turns out as the last one ... with the most lenient possibble outcomr. I know what the law says about what this man did. But I, for one, feel lthere has to be an alternative for parentts truly protecting thdir children. In fact, I think this is a travesty of the justice system. This guy did not only do his daughter, but society, a favour. Instead of tossing him in jail, they should have given this father a medal. He did what he did out of a parent's desperation, and a parent's love..

Walker probably had every just cause as a father protecting his 15 year old daughter from this piece of garbage who was addicting his daughter to morphine. There would be many of us that would have done exactly the same thing no matter what the consequences would be. It is the natural instinct of a parent, especially for a daughter to give full protection through out their lives no matter what age to look after them as long as you are able. Than again you can't take the law in your own hands , that is what the justice system and police are for. I hope they treat him leniently. It is sad that it had to come to this extreme.
