A Liberal senator accused of misusing public funds and instructing a Senate staffer to cut down trees at his cottage has been found guilty of fraud and breach of trust.

The charges come more than three years after Raymond Lavigne was officially barred from the Upper House.

Lavigne, a Quebec senator appointed in 2002, was initially suspended from the Red Chamber after being charged with obstruction of justice, fraud and breach of trust.

However, Ontario Superior Court Judge Robert Smith found Lavigne not guilty on the obstruction charge.

The judge told the court that Lavigne "used and intended to use his public office for a purpose other than the public good."

The court said that the fraud amounted to $10,120.50.

Since being kicked out of the Senate in 2007, Lavigne ran up an additional $700,000 in salary and office expenses.

Between 2007 and late 2010, public financial records show that Lavigne spent $135,000 for travel and $180,000 in office expenses. He also collected $388,500 in salary over that period, CTV News reported last year.

The guilty plea could result in his permanent expulsion from office. Last year, NDP critics had called for a legislative motion to cut Lavigne off from his office expense account.

Lavigne is a former Liberal MP who was appointed to the Senate back in 2002. However, he was expelled from the Liberal caucus in 2006.

Lavigne's behaviour first aroused suspicion in the summer months of 2005, when an aide was spotted on his Quebec property chopping down trees, the court heard. The yard work resulted in the destruction of saplings on a neighbour's property, according to evidence.

After the neighbour complained, an investigation led to criminal charges.

The highest about of theft is commited by employees in dept stores, food stores and any other type of buisness, no matter how hard management tries to stop this from happening.And its hard to say the say thing is happening at the government level. It would be intresting to see what these stats are in each province. Every political party is quilty not just one, so before the Liberals start shooting off their mouths their past record sure isn't any better.

@Matt in NB: In answer to your question, the reason PM Harper did not remove Lavigne from the Senate or stop his salary and allowances is that the PM does not have the power to do those things. The Constitution states that a Senator can only be expelled by the Senate itself, and only after being convicted of a high crime. Unfortunately, Canadian voters also lack the power to fire Senators, because the Liberals have consistently blocked every attempt by PM Harper to reform the Senate.

The Liberals have been falsely using the word "fraud" to describe civil charges against two Conservative senators for over-spending the party's campaign limit. Meanwhile, the only Senator who has actually been charged with (and now convicted of) fraud turns out to be a Liberal. Defamation is bad enough, but in this case it's compounded by hypocrisy.

Mahanna Ali makes a couple of factual errors. The convicted senator did pay back the money. The Conservative riding associations did not pay back the grants they got for "spending" the money the national office spent.Paying back the money doesn't excuse the senator of the fraudulent way he got it, and he deserves to go to jail. Just as the Conservatives do, for fraudulent accounting to get those grants.

You know why they do what they do (politician that is)...it's because they know they can get away with it with minimal repercussion. They know it will be taken care of and everyone will forget about it after a while and life goes on. It's your money and mine, but who cares, they get caught and move on to another job and start over. This is the life of a POLITICIAN. We read daily of the Liberals demanding that money not be wasted. Will they now demand repayment of the $700,000 paid to this man? Expelled from the caucus, kicked out of the senate, how is it that he was allowed to run up expenses? I can understand being on paid leave until the outcome of the trial - but leave does not justify expenses billed to the senate. I call it fraud.

this senator was found GUILTY of fraud...the conservative senators have only been charged thus far.....the liberal senator basically stole tax-payers money (and not paid it back) - this seems to be a never ending enigma with the liberals.(ad scam, e health...etc). the conservative senators in question are accused of breaching the spending limits. however that was spending their OWN (conservatives) money...there are glaring differences here....and to think that the liberals want to rush a no confidence vote the day before the budget is due to be tabled and try to topple the harper government on ethics and parliamentry conduct unbecoming.....HOOKAY!!!

Where are all the usual PM Harper haters?Haven't they got anything to say regarding this Liberal Senator scandal. Wonder why?????It is unimagineable that this has gone on for so long, the Senator has still been collecting his salary, and nothing has been done. Now we know why the Liberals have been blocking any kind of Senate reform at every turn. Only thing is, somehow this will be buried by the media, while anything derogatory about the Conservative Government will likely continue to be "news fodder" for weeks to come.

And another 'Quebec' Liberal is found guilty of fraud, a serious breach of trust. Liberals have a history of political frauds in Canada and this is the most recent. Liberals are great at accusing others of wrong doing but all too often at the end of the day it is the Liberals themselves who are found guilty of the fraud and breaching the public of trust. Trust and credibility are not Liberal strong points unfortunately and this man is a Senator one of their best supposedly. Draw your own conclusions but for Liberals have shown once again that they cannot be trusted with political power. McGuinty is another example of colossal Liberal waste and broken promises followed by more lies. This is a serious political pattern and it needs to stop.

"Political Independant" asks for a comment from Ignatieff, but I'm not sure why. This senator was kicked out of the Liberal caucus in 2006, before Ignatieff's time as leader. It was obvious he'd cheated, and so the Liberals wanted nothing to do with him.Now if we had that sort of behaviour from the Conservative party about their candidates and organ who have ripped us off in the in-and-out scandal, Canada would be a better place.

I'm not one who,as "Political Independent" says,believes they are all corrupt.Though there is room to believe the system corrupts a lot of them when they've been ther to long.In this case, it was for his own personal gain.Sometimes it's just about people who want to get frustrated with the system,and take short cuts to get their pet projects done. Sorry "Ronald",but you're making yourself look sdilly be defending this guy.In this story,the issue is the Senator.Trying to deflect the issue is a common Liberal tactic.That's how they dealth with the "Sponsorship" theft.When we all grow up a little more,thieves will be dealt with by the justice system,regardless of which part they represent. I have symapthy for the poster who says we should all elect independants.But I doubt it's a system that would work.Given that we can't get a few party leaders to agree or find compromise on anything,it's almost certain that we'de never get more than 300 MP's on even the simplest of matters.Then,voters would have to "vet" these independants on every single thought they ever had,or we would have no idea what they would actually stand FOR.Or,for that matter,what they satand AGAINST. I will say this though,blind loyalty to ANY part is a mistake.Different times and circumstances require different approaches.And every paret needs time in opposition to re-built and refresh itself.To me,"independant" means feeling free to vote for anyone,in every election.Not tied by family tradition,to hear only one side of the debate, and vote for the same party,every time, regardless of the facts.

I'm struggling to understand how this individual could rack up an average of $10,000 PER MONTH in expenses since his expulsion from the Liberal caucus and removal from all Senate committees. Just what "business travel" could he possibly be doing on behalf of the Senate, if he is not allowed to participate as a Senator? And, he can keep doing it until the year 2020? If ever there was a justification for either an elected Senate or its' complete abolition, this is it.

I want him to give back all the money for the fake lake, over price bug spray etc... that he wasted during the G8 and G20 summit return to the taxpayers of this country. The silence is deafening.We need a PM elected by the members of the House who are themselves independant elected members (ie don't represent any political party). This PM would them select a cabinet from amoung the members of the House. The Senate: What a waste of the working man's taxes that they pay!!! The man was expelled from the liberal caucus in 2006 and yet he can retain his $124,000 yearly salary. Hell! The senator was found guilty of theft and he still able to defraud the canadian people. The Senate and the patronizing that led to all those cushy appointments. Ladies and Gents. It doesn't matter what political party you belong to, these politicians are corrupt. There's a simple fix however; don't elect members representing political parties. If you have an independant candidate in your riding, elect him/her! Perhaps with enough independants in Parliament we will finally get some representation for our tax dollars and OUR elected members will be answerable to those who elected them vice a dictated "party line" from a corrupt political party.
