The Harper government is citing concern over security as reason to ignore a parliamentary vote passed by opposition MPs Friday, demanding it release uncensored information on Afghan prisoners.

International Trade Minister Stockwell Day says the government will follow a law that allows it to not release information on security grounds.

"The law is very clear that if there are elements of security, elements that could affect the security of our soldiers or civilians, then information will be protected," said Day, who also chairs the federal committee on Afghanistan.

He said the opposition MPs who voted in favour of the release can appeal if they wish.

The vote came on the heels of a revelation by Canadian Gen. Walt Natynczyk, who said Wednesday that a prisoner handed over to Afghan authorities by Canadians, was beaten while in Afghan custody.

Demands for the release of prisoner documents first surfaced last month when senior diplomat Richard Colvin told a House of Commons committee that Canadians handed over prisoners to Afghan authorities, where he said they were likely tortured.

Defence Minister Peter MacKay has argued that releasing the records "could be helpful to the enemy" and jeopardize Canadian troops.

Friday's vote came on the last day of Parliament before the winter break -- with debate resuming in the parliamentary committee in January.

In the motion passed by opposition MPs, the government would be required to release thousands of uncensored confidential records on prisoners.

The Liberals, NDP and Bloc Quebecois passed the motion 145-143. Constitutional expert and Queen's University Professor Ned Franks told CTV News Channel this is the first time in his long career that a motion of this kind has passed in Ottawa.

The Conservatives rule with a minority government and can be mathematically outvoted by the opposition, if the majority of opposition MPs vote together, as was the case Friday.

If the Conservatives ignore the order, as Day suggested, the opposition could vote to find the government in contempt, setting the stage for further battles when debate resumes. Parliament would then take recommendations by a committee on how to proceed in any contempt case.

Franks said the only sanction Parliament can take is to confine the minister to a hotel room until the end of the session.

He also said that if this turns into a court battle, Parliament would not be allowed to discuss the matter.

The opposition motion said Parliament has "undisputed privileges" under the constitution, including the power to "require the government to produce uncensored documents when requested."

But Justice officials say politicians must respect limits to what can be released under privacy and security laws. But Commons law clerk Robert Walsh says MPs in parliamentary committees have the right to read uncensored documents.

Colvin, who was at one point Canada's No. 2 official in Afghanistan, told the committee that he informed the government in writing about suspected incidents of torture by Afghan authorities but says he was told by people higher up to stop writing about the incidents.

The Harper government has repeatedly attacked Colvin's credibility in parliament. About 95 former ambassadors have signed a letter of protest over Colvin's treatment.

This is all theLiberals fault for sending our soldiers there in the first place so I agree with the stand the PCs are taking. These docs are considered to be of National Security and we know what happens a bunch of Liberals get hold of anything, they have to Blast it all over the news media, even if not proven, in hopes to gain points at the polls. We do not need to know everything about Afghan detainess that may have been abused, they have butchered enough of our soldiers. The only thing we need to know is, if any of our Soldiers were doing any of the dirty deeds. We have an Elected government to take care of this matter for us and they have been doing a very good job. at it. The LIberals are on a fishing expedition and I say, NO WAY IGGY! If you dont like it, bring down the Government and call an election, then we can vote Harper and PCs a Majority..

The problem is not in fact that some prisoners were tortured (I don't think they should have been but I can deal with it). The real problem is that this government is INCAPABLE of the openess they promised and seem INCAPABLE of telling the truth or even convincing lies.I really don't respect people who are so sure they are the smartest in the room that they assume we will believe the absolute nonsense they are spouting.Admit you screwed up, ask for foregiveness and you probably will be forgiven if you are doing a good job else.They are too concieted to do that and that is why I just don't trust them!

Good decision by our government, although it will undoubtedly cause another temper tantrum on the part of the Opposition. You see, liberals and socialists in Canada love to lecture about how our parliamentary system is supposed to function (with their usual self-interested bias); however, they won't be able to grasp the idea that the government of the day isn't lawfully obligated to satisfy their partisan demands, with grounds. While there may be a valid legal issue with handing soldiers over when they are likely to be tortured, the average Canadian cares more about the soldiers coming home in boxes.I think the Conservatives better reflect my feelings.

I am presently in Canadian Forces.If I thought for a second that any goverment party was ordering secret documents to be displayed to the general public, that would endanger my men...I would destroy the documents, and accept charges or court martial. Priority, Mission, Men, Self. Giving up safety of our troops should not be even considered, even more so when there is no solid proof.

I would recommend that both the government and the opposition tone down some of the rhetoric on this issue as things are getting far too overheated. There are no political points to score nor any moral high ground for either side to claim on this one. The only winners when confidential military documents are released to the public are our enemies and I for one am not comfortable with that.

In a case going back to 2006, Mr. Justice O'Connor said that the government of Canada should not wait for "unequivocal evidence" of torture before acting.

He said it was enough that there was the possibility of torture.

We need a public Inquiry.

$20 to my local charity says that Harpocrite will try to stonewall long enough until the point where he is forced to release the docs to MPs to read but will instead force an election to prevent them from reading what we already know ... that Stevey, Petey and Gordo already knew about the detainee transfers and abuse by AFGHAN authorities (not Canadian soldiers as the CONservatives would try to lead you to believe the Opposition said).Btw, unlike Steve, I'll be contributing to the charity regardless and not depriving them of needed funds.

How can these 109 people be so insensitive to the mother of a soldier.I know that the Liberals are against anything good said by a Conservative, but come on, this mother deserves our compassion, not "thumbs down" on a comment made about Stockwell Day praising our troops. Our troops deserve all of our praise, they are putting their lives on the line day after day for our freedom. I hope those of you with the "thumbs down" on this one are ashamed of yourselves. The only dereliction of duty here is from the Conservatives. The government is responsible for ensuring the policy established for the troops to follow is legal, moral and sound -- failure to do that puts the troops in harms way.International law and conventions of war are for our protection as well as the protection of our detainees. These antics concern me - Parliament is not supreme - their desires are overturned on a regular basis by the courts - so that argument is false. What concerns me more is that a group of MPs (in a fit of pique and bloodletting) are demanding whatever they want for whatever purpose and what they want is against various pieces of legislation, but because MPs want it, they are willing to ignore the legislation. I think it is a bad practice, and it hits close to home - what if a group of MPs decide that they want my income tax files (for whatever reason they have decided that they need that information and they want it now)? With this a a precedent, nothing would be protected information.

If the Conservatives believe this to be a National Security issue, then why are they not regarding this Commons vote as a matter of confidence also?Seems to me, placed within a supply bill or not, that money bills and bills regarding National Security are automatically regarded as such, as are outright non-confidence motions, of course.If the Conservatives were so sure of themselves, they surely would have jumped at the chance to vehemently condemn opposition 'treachery'.Something sure smells about this...

I live in Winnipeg MB and with the snow and – 30 c , the econamy, homeless people and increase in gang violence especially shootings in my city I really could care less about how terrorist who try to kill out troops were being treated. the Conservatives puts law abiding, tax paying Canadians first unlike the Hug a Thug libreals and Iggy who puts himself first.Say what you will about the Conservatives but most Canadians think they have done a good job for Canada and the latest polls prove just that.

We'll have to wait and see how Harper and his ministers fare when others outside our country decide to investigate this scandal and our breach of the Geneva Conventions. They won't be able to prevent evidence coming out when that happens. If they want to be truly accountable for their actions, they should be honest with Canadians, stop their disgraceful behaviour, and let us deal with this in our own country. If not, I'll be the first one to sign on to a request for outside intervention.

Once again the sheeple blather on about the Geneva convention. It does NOT apply. As was pointed out yesterday(and quite a few times before that), the Taliban are not covered under the Geneva Convetion. Secondly we operate under the Laws of Armed Conflict and the LAW demands captured prisoners are turned over the the country of conflict. Our troops did not torture any prisoners, this is not Somalia. What happens in Afghan custody is their problem. And let's define torture....not some vague...oh my handcuffs were too tight.

The current government has been using many tactics to keep facts away from the people. This goes back to the government's control of the press office. Every comment responding to getting a clear picture of what the scope of the fault was, was responded with "we have dealt with the matter as it should have been. " The government has to be transparent to the people and that is not happening.

Of course it's a non-issue if it will reveal the truth about your dictator and his band of sheep. Demanding uncensored documents through this political stunt puts the safety of our trops in jeopardy. This is the most made up political bomb ever. The Liberal party, and all of the Liberal newsmedia in this country really need to get themselves a reality check. First off we are mandated, to turn over all prisoners to the Afghan authorities by an agreement which, correct me if I'm wrong, was put into place by a Liberal government. Our people there, presumably Corrections Canada, are keeping an eye on the detainees after we turn them over. We don't have any details of what the torture entails, other than a handful of vague statements from un-named sources. It could be that the "torture victim" was made to sit somewhere with handcuffs on and was uncomfortable. I really don't see why this is an issue for Canadian parliamentarians to debate. Surely they have more pressing issues, such as how to stop Canadian soldiers from being killed by roadside bombs set by terror suspects in Afghanistan.

Reading the post by "John E" makes a bit os sense to me.BUT,he should know that his idea is a knife that cuts both ways.If the opposition wants PM Harper to respect the House of Parliament,he has a right to expect the house to show respect for the office of PM,the military at the heart of this issue,and all the other institutions the government is responsible for. If this issue was real,and really about Taliban detainees,ALL parties woulde be working quietly to remedy any shortcomings that the current prisoner situation may have.They would not be using it as a political fooball in a partisan attack on any party in power.They would recognize that they are ALL there to represent CANADA.Not the Taliban. I'm sorry if I offend Liberals and NDP'ers.But a war is a war.All parties need to work together to get us through this nasty mission.And do it without partisan rhetoric.Just as former PM Trudeau and former PM Clarke did when faced with a situation in Iran several decades ago. If the system is broken,FIX IT!! When did a beating become "torture". Anyone who has seen news clips from Pakistan and other eastern countries has surely seen the police and military with long sticks wailing the hell out of the populace at demonstrations and other gatherings to maintain order. Suggests it is normal procedure and certainly not torture.In fact it was only about 40 years ago that we quit using the lash ( "cat o' nine tails") in our prisons.

This story may not sink the Harper government but it does shed light onto how this government operates. For a lot of us it further confirms our worst fears: everytime they open their mouths what we hear is political spin which may or may not have anything to do with the truth. Does Mr. Harper think that if he continues to down play these allegations they will go away? The opposition smells blood and rightfully so. The lame excuses we've been given as to why Mr. McKay attacked Mr. Colvin's credibility are an example of what the conservatives are all about: if the message is going to hurt the Conservative party then attack the messenger, doesn't matter if they have been lying all along, attack, attack, keep spining the issue to try and make it sound like anybody who is trying to get to the bottom of what actually was going on does not support the troops. Give me a break! This is Karl Rove/Repuplican politics at its worst. Why doesn't Mr. Harper just get up and say that like the U.S. Canada no longer follows the Geneva Convention?

So the issue is were taliban soldiers tortured when handed over? I assume they were, there is a war going on in afghanistan. Why is it to be the responsibility of the Tory government. If the Liberals were in power would it be any different? If our forces do their job and hand over prisoners to the afghan forces, our responsibility stops there and rests on the afghans

It's a good thing that our elected officials have nothing better to do for the past month than to worry about prisoner abuse. Last time I heard we were at war and some thing should be kept confidential to protect our troops. I'm sure any of the allied troops captured would never be abused.

The vote narrowly passed at a count of 145-143. Wow, are we that close to a majority government? Just think, as soon as the Conservatives hold an actual majority, they can then withhold all the infomation they want - and will never look bad again. I suppose It would be nice to have all the facts brought forth but I can't help thinking "here we go again". There seems to be no end to these special hearings and comittees. How much is for the actual good of the country and how much is just partisan politics remains. One thing for sure is that due to the stubborn un- cooperative nature of our elective reps the taxpayer will be footing another massive tab to perhaps get to the bottom of this issue.

Before he was elected Mr. Harper spoke often of the importance of the House of Commons; however, since elected he as shown nothing but comtempt for the House. I'm sure he will force this all the way through the courts at great expense to the Taxpayer. I'd rather spend my taxes on a full blown inquiry so we can try and find the truth and take whatever action is required.

IIf the opposition really feel strongly about defending terrorists then bring down the government so the Conervatives can have the majority and continue to govern the way we elected them to govern! This issue seems to me to be a waste of time and taxpayers money, what is done is done, find some way to prevent this in the future. Lets get on with putting our economy back on track, if all the parties put more effort into getting this country back on track rather than somewhat petty arguments, we would be far better off. Just my thought on the subject.

what an incredible waste of time, energy and money...there are two committees investigating, already all of Canada and most of the world know that there were problems with detainees in Afghanistan, and the opposition wants more???? Corrective measures were put into place and new policy, which should have been in place when the Liberals sent the military into Afhanistan in 2002, is being followed. We do not need to spend all this effort on deep finger pointing because in the end it will come out that the Liberals, Conservatives and high ranking military officials are all to blame. Please move on
