Foreigners set up fronts to procure Canadian weapons: cable

Hundreds of foreigners and dual-citizens are in Canada with the purpose of creating front companies to procure weapons parts and technologies that they then export to their home countries. And they often go unpunished.

That's according to a Wikileaks cable that documented a meeting in 2008 in Ottawa between Canadian and U.S. export and border control officials.

The cable reports that George Webb, strategic export controls division manager for the Canada Border Services Agency, struck a "discordant note" when he told Frank Ruggiero of the U.S. State Department that he faced many challenges in enforcing sanctions and export laws.

Webb was cited as saying his "hands were full targeting hundreds of mostly Iranian and Chinese foreigners and 'lots of Canadian dual-nationals' involved in 'non-legitimate businesses,'" according to the cable.

"They create front companies for the purpose of procuring defense technologies," Webb said in the cable, which was written by a U.S. State Department official and approved by Ruggiero.

Webb also complained that after CBSA officials make the arrests, the suspects are often released on bail by judges, and they "simply disappear," according to the wire.

He said he was aware of about 25 court cases involving export control violations, but only one that resulted in jail time.

"Canadian Judges do not appreciate the seriousness of these crimes," Webb was quoted as saying.

The U.S. officials were particularly concerned about the lack of co-operation from Canada on two alleged violations.

In one case, according to the cable, CSIS officials had blocked co-operation with Immigration and Customs Enforcement (ICE) on an individual in Canada believed to be involved with the fabrication of missile parts for Iran.

In the other case, the U.S. officials were concerned about the sale by Pratt and Whitney Canada of U.S. military-grade helicopter engine technology to China for use in Chinese attack helicopters. U.S. officials complained that there was a lack of regulatory oversight and Canadian law enforcement officers simply didn't seem interested in helping address the alleged violation.

"The ICE officers argued that until the price to be paid for export control violations is the same in Canada as...it is in the U.S. -- prison -- adversaries will persist in abusing Canada as a venue from which they can illegally procure and export U.S. defense technologies," the cable said.

In the course of the conversation between the U.S. and Canadian officials Bob Paulson -- now the newly minted RCMP commissioner -- admitted it was often difficult to prosecute export violators. As a result, he said the "greater good" was often achieved by other means.

A note in the cable added: "This was understood to mean exploiting wrong-doers for their intelligence value or turning cases over to regulators for civil sanction."

At the time, Paulson was the RCMP's director general for national security criminal investigations and operations.

I believe that Canadian military contractors will do just about anything to make a sale They don't care who they sell to and if they were decent honorable people they would not be in the business of making and selling weapons in the 1st to, the government sees to it that these weapons are of infierior quality to what Canada and the US. are useing . The reason the US. is objecting to Canada selling these weapons has nothing to do with classsified weapons technology being lost .It's a very simple matter of the USA wanting these sales for themselves and useing political arm twisting to get it .

All the more reason for the "tough on crime" legislation. These are crimes that deserve more than getting out on bail and then disappearing after being arrested. In fact that happens far too much in Canada in regards to various crimes. Time for the "slap on the wrist" days to end. For those that are going to say..."but crime is declining", I would say " in whose dream world".

Economic espionage is the primary threat facing Canada. In simplest terms it is cheaper to steal our intellectual property (for products and processes), than to fund your own R & D. It's time that we took our heads out of the sand: according to a 2001 audit (By Price Waterhouse Coopers) the U.S. economy lost approximately $60 Billion to economic espionage. With drastic increases in technology, we can assume that this amount has at last doubled (also assume that the Canadian figure is in the tens of billions). Given the open nature of electronic commerce and lax business security practices the Canadian economy is taking a significant hit. Government is not in a position to address the problem efficiently, when businesses are victimized they are usually too ashamed to report it. Canadian firms have to take responsibility for their own security, by the time most realize that their research is stolen it is too late.

I suspect one reason for the lack of prudence from our judges is because those judges are only concerned about the relatively narrow scope of their formal responsibilities. Our educational system rewards candidates who score high on narrow lists of criteria. I suspect the judiciary is particularly affected because the focus is on legacy textbook cases and old courtroom precedents, not on realities of today. We need to widen the scope of consideration when dealing with crimes that may only represent part of much broader criminal or espionage activity. Judges need to cooperate with other authorities when determining sentence.

And another reason why I'm not totally with Immigration these days, before you know it we will be hearing about how we must say "Happy Holidays" again instead of "Merry Christmas". Although there are immigrants who for the better of themselves and OUR Country come here for a just cause but others I'm not to sure about. With our Canadian open door policy towards immigration and the embrace of multiculturalism, like a mother for a long lost child, is it or should it be a great big surprise?? CSIS not co-operating with Customs and Immigration? Questionable suspects being released on bail and "disappearing"? Any individual or corporation that doesn't seem to care enough about Canadians' safety, well being and conduct in the international theatre by not co-operating or blocking investigations should be dismissed from their duties and charged with obstruction of justice. I'm certain that in some other parts of the world, like the ones these individuals/ criminals originate from, wouldn't be as merciful as our country is. Your first offense there may be your last. In defense for our security, maybe we should take a second look at how we really do things.

Foreign nationals have been trying and succeeding to buy military tech from the west for decades, this is nothing new. Communist China has been very active in their attempts on this for the last 10 years or so, and have been fairly successful. If we are serious about prosecuting them them change the laws and make it an espionage related crime but include seizure of assets if a company is involved.

The problem with Canada is that CBSA needs to be a broader mandate such as the US Immigration Customs Enforcement; CBSA is the expert authority on these types of enforcement but it seems the last decade has been spent stretching the all in one RCMP to do area that frankly they aren't the experts on. Let the taxpayer funded Border Agency do what it's world renowned to do and bring back the RCMP to what was once a world class service; just my two cents

@JP this has nothing to do with the gun registry. scrap it. You don't register helicopter engines do you? how would it help?Hopefully with all these reports about our immigrant visa system, and lack of balls to prosecute these people, we as a country, will raise the gates a little.

And how is this a surprise? Our Ont govt is actively throwing money at foreign students who want to come here (which is appalling), the second many Chinese students get off the plane they hightail it to immigration to apply for landed status. You take a look at how many foreign students from China and the Middle East are in Canada - this story is just the tip of the iceberg.

I appreciate that many dual-nationals have less than complete allegiance to Canada, but banning dual-nationality is the wrong path. We have to respect Canada's historical relationships with other countries. Those who are dual Canadian-British nationals and dual Canadian-French should never have their citizenship status questioned or altered in any way.

United of State of America should first talk about itself, when USA has, and still opens, front businesses in Germany and Turkey to do business with IRAN. England has a huge Pharmaceutical profit interest in IRAN .America wants Canada and other countries to stop doing business so they can grab the money. PS: CANADA hasn’t learned from IRAQ affairs that we should keep our distance from USA and for Harper to stop being a hand puppet. Again remember IRAQ? Good thing about Canadians is that we are more educated and we think first unlike others.

Dual Nationality is not offered only by Canada, other countries(like UK and US) also do. But they do not have these types of issues. I guess national security should be more robust.

Can this report go one step further and disclose that Israel is one of the countries that spy the most on Canada? Can those who ask for ban on dual citizenships ask Canadian Jews, many of whom have Israeli citizenship, to give up their other citizenship? Oh, no. To become a Canadian citizen, dual citizenship should become a thing of the past and by continuing to permit people to dual citizens will only allow the wolves to hide amongst the sheep when citizenship is approved, thus allowing the undesirables to slip in through the cracks and use and abuse the kindness and freedom that is offered by Canada. I was watching Lord of War the other day and I wondered how many people who are in this country, violating these laws and sending military equipment overseas that will be used by a child soldier or used in the killing of innocent civilians.
