Never mind the peanuts and crackerjacks. Toronto Blue Jays fans want their favourite beer guy back.

Wayne McMahon, a 61-year-old beer vendor known for his trademark beer holler, was fired July 8 and since then, fans have turned to the web to fight for his reinstatement.

Aramark, the company in charge concessions at the Rogers Centre, says he was let go because he sold beer to someone without checking their identification first.

The customer turned out to be a 22-year-old mystery shopper who ordered two beers.

"Our policy requires vendors to ID everybody who appears under the age of 30 and limits beer sales to one beer per person per transaction in the stands," said company spokesperson David Freireich. "When we employ mystery shoppers, we use individuals where there can be no question about his or her age and the need for vendors to ask for identification."

McMahon, who has been working every Jays game for the past six years, was fired on the spot.

Daniel Lublin, the Toronto employment lawyer representing McMahon, says his client believed the customer was also ordering for his friend. Regardless, he said, immediate dismissal was too harsh a punishment.

"A dismissal wasn't a proportionate response," he said in an interview with CTV.ca. "They didn't consider his previous history. He had passed all six of his mystery shopper exams."

The situation "just doesn't make sense," Lublin said, which leads him to believe there would be other factors involved in the dismissal.

"I think there might be other factors involved but I'm not prepared to comment on what they might be."

McMahon said he has a spotless employment record and has never been in trouble before.

"Do I speak my mind? I absolutely do," he said in a telephone interview with CTV.ca. "There must be more to it than that because I don't understand this in the slightest."

McMahon said he was "crushed" when they told him he was fired.

"I absolutely loved coming to work every day," he said. "I just can't believe I lost it. I'm completely crushed."

Lublin wrote a letter on behalf of his client to Aramark on Monday. On Wednesday, the company responded, saying they were investigating the incident, Lublin said.

McMahon is considering suing the company for wrongful dismissal, something his legions of fans have been clamouring for him to do.

Fans to the rescue

On July 11, an online group and petition was formed on Facebook, a popular networking website. Since then, 4,602 members have joined but that number is growing by the hour.

"Wayne McMahon is a legend of epic proportions," wrote one member. "I usually go and see about 10 games a season but I refuse to return to the Rogers Centre until Wayne is reinstated. 'Till I hear ICEEEEE....... Coolllllddddd...........Beeeeeeeeeeeeeeeeerrrrr! We love you Wayne!"

McMahon, known among his fans for his trademark beer holler, is also getting some sympathy on his personal Facebook page.

"I've been a big fan for a long time and I'm not too pleased about Aramark's decision," wrote one person. "I'm behind you 100% and I will not be attending any Jay's games until this wrong is made right. All the best to you friend."

The only way for McMahon to return to his job is if Aramark agrees to reinstate him, as a judge does not have the right to order the company to give him his job back. Rogers also can't step in to save his job, although they can suggest Aramark give the man another chance to appease Blue Jay fans.

Public pressure also carries a certain amount of weight, Lublin said, which is why he's urging McMahon's fans to sign the petition.

However, the issue for McMahon is not the money, but the fans, Lublin said.

"He really just misses his job," he said. "It was never about the money. He has a love for the game and his fans."

McMahon, who in the 1990s was a successful sales manager making "very good money" said his T4 slips are now less than $5,000. He doesn't care though, he said, because the extra dough helps feed his golf addiction.

He'll be back

McMahon said he hopes he'll be back at the Rogers Centre, performing his old shtick. In the meantime however, MTV has given him a job as an announcer during MTV Live. Once in a while, they ask him to growl "ICE COLD BEER."

The crowd at MTV goes wild, just like they do in the stands, he said.

"I've always had a good voice but being in sales, I knew I had to differentiate myself from the other vendors," he said when asked how he came up with the holler. "I came up with a concept to say "cold" in a way that would really make people shiver. Then I thought that what sells best is sex so I say "beer" in a sexy low growl.

"I know it's crazy but that's how it started," he said, laughing. "People go absolutely nuts for it."

In fact, one woman proposed to him once after hearing him at a baseball game. But the self-professed flirt turned her down.

The divorced father of two said he's thrilled at the MTV opportunity but that what he really wants is his old job back. He won't even consider lending his talents to the Toronto FC, the Toronto Argonauts or the Toronto Maple Leafs.

"I was at the first ever hometown Blue Jay game at the Exhibition in the seventies," he said. "This is my home. I love this game."

As a former bar manager I have to say that incidents like this disgust me. For someone under 30 in this province it can sometimes be easier to get through US Customs (post 9/11) than it is to get a beer. A beer FGS! Though Aramark was definetely too harsh with their firing of Wayne, the real problems are the province of Ontario, LCBO, and AGCO. These organizations pass draconian laws whose emphasis is on protection from liability and the "compensation culture" that runs rampant in North America. We need only look to Europe to see that there is another way, a better way, and that our way of policing alcohol may be more detrimental to responsible drinking than a benefit.
I am 22 years old btw. When I go to sporting events billboards and vendors scream at me to buy beer. When I go to purchase one sometimes I feel like I'm about to be cavity searched. The irony!

I agree that the beer guy should be reinstated, as this seems like over kill. We should boycot any food purchases from Rogers Centre!!! Maybe Aramark will then listen.

I feel sorry for the guy, but the bureaucrats at Aramark are scared of losing their own jobs and won't put their mortgaged necks out for anyone.

My company buys hundreds of Blue Jays tickets a year, to give to customers. We will not purchase another one until Wayne is given his job back.

A bigger issue is that Ontario is too uptight about drinking!!!!

¡§Anyone that looks under 30¡¨, give me a break, the legal age is 19 remember.

And what¡¦s with the beer stores??? Get over it already, no other province is as anal.

Especially here in Quebec, we even sell beer at the library¡K¡K : )ƒº

If you have been to a ball game you will notice that a lot of the time the people buying the concessions sit a few seats into the stands. Money is passed down in exchange the drink is passed back.
It is a disturbing and difficult enough procedure. It would be even more difficult to first pass down your drivers license which you actually aren't even permitted to do so by our law.

I'm a Payroll Compliance Practitioner (PCP), and one of the things we look for if an employee is about to get dismissed is just cause, and how it would seriously affect the operation, reputation, or management for a company. To prove it, if there's documentation that supports the termination, then it's a green light.

If they fired him on the spot, then he has a legal right under Ontario's Employment Standards Act, to file a complaint to the Labour Board. It would be beneficial for the fans to submit the peition to that board too.

I am 31 i get I.D'ed all the time,people say i dont even look 20(i guess iam blessed). When it is at the vendors discretion to sell to someone who looks to him to be over 30 how can entrapping them like that be legal? My Idea of someone who looks to be over 30 can completly differ from someone elses.

Wayne rocks the jukebox! Took my lady to a Jays game on our first date, sat in his section and ordered beers off him...loved his gig.. he definitely broke the ice for us! Thanks Wayne...its paid off in spades...Get back soon.

First, I haven't been to "Skydome" in years. I think Ernie Whitt was catching then. Besides, I refuse to pay big bucks for a half-decent seat (within 15 rows in the infield). The ozone layer is out of the question. Up there,it's like watching a bunch of fleas run around a pool table.Now, to the case in hand. I've read about "The Beer Man" from 2 sources & I don't see that the mystery shopper is a "she". If "she" was, is she an American too? Question?? What in hell is an AMERICAN company doing selling beer or anything else in a CANADIAN stadium. Now, give MR.McMahon his job back, with an apology for being too heavy handed, apologize to the Blue Jay fans,let's get life back to normal at "Skydome", then ARAMARK, go home.

Good for the company! When an employee disobeys the rules, they get what's coming to them. Now there is a job opening for a new employee who will respect the regulations.

I'm a marginal Blue Jays fan, but I'm a die-hard Wayne fan.

Hire him back. $200,000 fine is only 18,181 beers -- what's that, like half a game's worth?

Get real & hire him back.

Outrageous conduct by the employer. I live in Calgary and when I get to a game (usually 1 - 2 times per year!) this guy is a key part of the entertainment experience. What does "appear to be under 30" mean? The "shopper" was in fact old enough to order beer (22) - maybe he "appeared" 30 to the Vendor. Perhaps the company should hire a 17 year old "shopper".

When the Jays are playing poorly the only reason to go to the game and pay for an overpriced beer is to see Wayne. 1 mistake is not worth being fired for. Bring Wayne back!!!!

Certainly there must be something else behind the immediate dismissal and not for just this incident...too harsh to say the least. I was considering going to a game this year but now I am not so sure. I wouldn't want to be responsible for getting someone fired for asking for more than one beer.

I doubt this has to do with selling two beers instead of one. There is one main reason why Aramark does this. The fines for selling beer to an underage person is staggering, according to the LCBO website it is a $200,000 fine (not two hundred dollars but two hundred thousand dollars) to the company and they can be sentenced up to a year in jail (sales person and executive both). To take as much precaution as possible and to show the judges that Aramark takes this seriously in case they did get caught, then Aramark needs to make sure that all employees follow the rules that are in place and as long as Aramark made sure each employee knew it was an instant firing for failure to comply with the ID check. The people protesting should be taking it up with the provincial government and the fines in place because a $200,000 fine for selling alcohol to a minor when an actual stock trader only gets fined $50,000 for intentional fraud that cause millions in damages makes little sense to me.

Can we see a picture of this alleged secret shopper? Maybe she didn't look like she was under 30! Beer vendors at these sports facilities have such an air of monopoly...just like the gas stations.

We have what you need and you can't geet it anywhere else, so we'll do what we want and get away with it because nobody in this country has enough guts to hold us accountable! Sheeple! Baaa-aaa-aaa.

That is ridiculous! Sure, he made a mistake and forgot to ask the person for their ID. But to fire him for one lousy mistake like that is ridiculous.

I go to at least 10-12 games per season at Rogers Centre and if the Blue Jays wish to see me attend anymore games, then I want them to pressure Aramark to re-instate the man.

He got fired for selling beer to a 22-yr old? I thought the legal age was lower than that?????

Regardless, it was only a mystery shop. He should have got a written warning or a verbal warning. 6 perfect mystery shops clearly shows he does a good job. Besides, he likely knew this person was over the legal age and didn't feel the need to ID someone who looks over 18/19.

Firing's a little harsh. There must be high unemployment back east there, if Aramark thinks they can replace Wayne that easy.

This punishment seems too extreme (especially considering he never sold beer to an actual minor). In any case, a warning, fine, or short suspension would have been a more appropriate response here for a guy with his experience.

What "Rubbish" anyone can make an oversight like this one! This guy deserves to keep his job!
One beer per serving! if you had buddies with you, the line up would be the only place that you would spend anytime at all! Come on-GET SERIOUS.

Seems like overkill to me. On one hand, he should have been following the proper procedure for beer dispensing, which he did not. But to fire him over that just seems so unfitting. A written or verbal reprimand or something. Maybe the super giant Aramark just figures he is an expendable employee, and that there is a line of people behind him waiting for his job.
