TORONTO — The Crown is pursuing lighter charges than it could potentially seek against a Toronto man who allegedly beat a family of raccoons in his backyard.

Dong Nguyen faces charges of animal cruelty and possession of a weapon for a dangerous purpose in connection with an alleged attack on the raccoons in the garden of his west-end home last month.

Crown lawyers told court today they are choosing to move forward with the charges as summary offences rather than indictable charges.

Indictable offences would allow for greater punishment, including a maximum sentence of up to 10 years for the weapon charge.

Nguyen, 53, could serve a sentence of no more than two years if convicted of animal cruelty.

His next court date is set for Aug. 18. Nguyen did not appear in court today.

Police were called early on the morning of June 1 after neighbours awoke to the sounds of a man allegedly attacking a family of raccoons with a shovel.

Animal services says one baby raccoon suffered some broken toes and was taken to a wildlife rehabilitation centre to recover.

Police don't know what happened to the other babies because the mother raccoon took them away.

After reading the article again, I'm appalled at the possible sentencing. I'm one of the first to react to any form of animal cruelty but the punishment MUST fit the crime. Even 2 years is too much for the dumb mistake this man made. If he has a past record or is a repeated offender? Yes! By all means, but if he acted in a moment of rage and frustration this should be considered. There are cases of out and out animal cruelty....such as a dog deliberately being dragged behind a car, where the creep gets less. Come on now, lets be reasonable!!!!

I think he chose a cruel and severe way to try to rid himself of the pests but I also think the possible sentencing in this case is severe in comparison to some other horrific cases of animal cruelty where the perps merely got a fine and a slap on the wrist. The laws and punishment for animal cruelty need to be revamped in favor of the innocent creatures who can't defend themselves. This article doesn't say if any of the racoons died. He should certainly face a hefty fine, with community service and a record of such behaviour. I hope his nationality won't have anything to do with his sentencing. One law for all and justice for the innocent animals always.

As a farmer I admitt racoons are not allowed near my barn as I value the health of my horses much more. And even though I dont like to I do "get rid" of them as needed, but I would never in my right mine bash in the heads of living animals with a shovel. I believe that this situation goes beyond animals rights and the law should really take into account whether this man has some sort of rage issue. If a couple racoons knocking down garbage cans can cause him to react this way what will he do if next time its some drunk teenagers kicking over the cans.

There are animals everywhere in the world, city or countryside, if you dont like it, get over yourself. Yes coons and squirrels are pests but they are living animals too and have every right to life that you do. Humans are bigger pests than anything. There is a major loophole in this system. Animal rights does give an animal the right to live, but what if an animal causes constant private property damage to the same person and that person gets a private company to take care of it yet the problem remains.

As much as this individual has to face the law, the law has yet to face the real test which is "pests" revisiting property and damaging it.

On one hand we are bulldozing natural habitats and putting up sub-divisions cluttered with mass produced, cookie cutter houses, thus forcing the relocation of dozens of species.

On the other hand, we purchase these homes and are solely responsible for the maintenance and costly repairs from the damage done by the very same species we blasted out of their natural homes.

I don't agree with forced relocation of any species, regardless of where they are in the food chain. And I don't want to pay hundreds to thousands of dollars in repairs to my home and investment either. I can see both sides of the equation but this one argument that will be split right down the middle.

This is ridiculous. Raccoon's are pests. There is year round open season for hunting them in a lot of southern Ontario due to overpopulation, yet if you live in a city you aren't allowed to do anything about it because of some tree huggers giving them human feelings. I have 2 of these vermin living in my garage and I want nothing more than to beat them with a blunt object every time I find more damage.
And I sure as heck wouldn't pay a trapper $200 to catch and release it around the corner so that it makes its way back again...
Want a humane way of resolving the problem? How abut legalizing the discharge of my 12gauge for pest control! I'd charge for ammunition only.

Raccoon or human.. it's still a LIFE. The animal doesn't know any better - it's acting on its instinct. Humans do wrongful things all the time, but that doesn't mean it's ok to attack them with a weapon! Why do we treat animals so differently?!
This man had intention to end a life so why should he face a lesser punishment? It happens so much more often lately and it's disgusting (talking about lesser punishments for crimes committed in general)!
Something has to be done to send a message to other animal abusers to tell them that this is wrong and unacceptable!

OMG. First off, I will say that I do not support animal cruelty. There are much better, logical, humane ways to deal with a pest. Someone beating on a baby animal with a shovel is disturbing and this guy should be given some kind of warning and/or fine,...but seriously, HANDCUFFED and charged with jail time? If they keep putting people in jail for things like this, then as a nation we will have no choice but to hand our new gov't billion of dollars to build these new super prisons...sigh.

I suppose he should have waited until the racoons attacked him (or a family member), or tore through his roof or siding to live in his attic, then paid someone some crazy huge sum of money for repairs and extermination.
Yes, I suppose that would have been the best way to get rid of the stupid things.
Urban racoons are fearless and can be really quite mean. He did his neighbours a service by getting rid of those nusance animals.

I understand the concern about the violent method he used on the animal beating it with a shovel, but he should be allowed to trap and euthanize, or poison the animals to rid the area of an ongoing pest problem like that.

These crazy rules about not moving it beyond a certain distance like out of the city is ridiculous they shouldn't live in such huge numbers inside the city. They need "population control", and the farmer's comment is right, it's solved with a .22 beyond the GTA boarder.

Straight up disagreeing with this article. If this story needs to be covered, the story should dig into a cause as opposed to just focusing on the act. They need to ask why. What would drive a man to resort to having to scare raccoons away with a shovel? Raccoons are animals, but at the same time they're pests that infest cities and carry diseases. The question is, what alternatives are there? Have you ever tried catching a raccoon before? These are the things that the story needs to ask, rather than just focus on the act.

I live in Etobicoke, and in my neighbourhood, the people get exactly what they deserve in terms of raccoons and other "pests". They leave garbage on the ground, litter everywhere -we live near a schoolyard and you would swear it's a landfill. Everyday while walking my dog I have to stop her from picking up chicken bones and half-eaten food items off the sidewalk/road that people have just dropped there. People live like filthy animals and then get angry when raccoons move in to partake in the food THEY couldn't be bothered to dispose of properly?? NO sympathy!! Noone has the right to beat an animal with a shovel - not when there are more humane options available.

At worst, this guy is probably guilty of hunting without a licence. A raccoon is a wild animal not covered by the legislation dealing with domestic animals. Injuring a wild animal is by definition "hunting" it and covered by Fish and Wildlife legislation. Once again, there is no need for "shock and awe" police tactics. We obviously have too many police on the payroll if they have time to pursue such nonsense as charging people with animal cruelty and weapons offenses in such circumstances as this one.

Agreed that arrest is not the right response to this issue let alone possible jail time where a fine would be more effective and efficient to our system. Attacking animals (pest or not) with a shovel is not a suitable response either. There are many alternatives to the problem such as live traps or calling pest control. These are living things and should therefore be respected. In the end it would have been much less costly for him to buy a couple live traps.

Apparently the raccoons didn't see the "No Raccoons Allowed in the GTA" sign. I'm not sure what you people would do if you lived in "the north" -- Parry Sound, Sudbury, Sault Ste Marie. I had a porcupine waddle up the driveway last week while bar-b-quing, and have watched bears wander across the lawn. Raccoons ARE pests, but there are better ways of dealing with them than whacking them with a shovel.

It still boggles my mind that there are so many people supportive of this man. I can understand him being angry and frustrated at raccoons, but to kill or to attempt to kill animals, especially baby animals with a shovel is just absolutely sick. I hope he gets an adequate punishment and faces some real, lasting and very uncomfortable consequences for his monstrous actions.

Hmm, if instead of raccoons, he had been accused of trying to kill a family's pet dog or pet cat (they can be just as destructive in the garden), would there be so much support for this person? I doubt it, I seriously doubt it.

AND where does it stop? Can we beat a cat to death? How about a dog that your neighbour lets out to relive themselves on YOUR lawn. Live traps or a radio on CBC talk for a few days gets rid of them too. This has nothing to do with private property or middle class. There going to the lower class and upper class places too. No mention of trying to do anything but beat them to death. This is todays mentallity, if you cant solve a problem kill the problem. The posters who raise the objection to people moving into the animals' habitat are wrong; this is a case of the raccoons moving into human habitat. The man should be allowed to remove/destroy these destructive and brazen pests to protect his property. Yes, raccoons are 'cute', but that does not make them anything more than destructive and nasty nuisances. The money used to prosecute this man should be better used to exterminate the pests.

We all have to live with wildlife since it's their home, too. All it takes is a quick Google search to find some humane ways to keep raccoons out of your garden. Get a dog, a motion sensor hooked up to spray water, a fence! There's absolutely NO reason to ever hurt innocent creatures.

Man has to learn to live with the wildlife surrounding us as we build more and more homes into their territory. It was not necessary for this man to attack these creatures (animals and not rodents by the way as so many think)by hitting them with a shovel. There are steps he could have taken that would not have done no harm to them and yet would have kept them off his property. If he had a problem with them he only needed to do the research or checked with Natural Resources Canada on what he could do for prevention. Oh yes but it is too easy for this type of person to be violent with them rather than spend a few minutes to solve the problem without resorting to violence. Oh and by the way we are the trespassers as we humans stole the land from these creatures and others like them who used to roam so freely in this country!! for children to be bit they must have touched the animal or were trying to feed them unless the creature was rabid, so why did the parents not teach the kids to stay clear of them?? Animals do not reason as people do (well at least some anyway)they merely react to what they consider a possible threat etc. People are the foolish ones not animals. I saw this recently in a trip to the west where I saw tourists get out of their vehicle to get closer to a black bear on the side of the road to obtain a picture! Had something happened who would have taken the blame - the bear likely would have been shot!!!

Raccoons are susceptible to a large number of different infectious agents including bacteria, viruses, and parasites. Several of these infectious diseases are zoonotic (rabies).

Dong Nguyen is also a victim of the city responsibility in term of controlling these annoying animals which damaging the plans and properties. Hope he is not got the disease from racoons.

I sympathize with this man in so far as he will now have to go through our court system - which appears to be a giant money making machine rather than an instrument of justice. However, I don't agree with the cruel treatment of any animal. If you are defending your life, fine - otherwise, use a live trap. The animals have lost so much of their natural habitat through urban sprawl and they are just trying to survive too. Taxpayers would be better served if this man had to pay a significant fine, rather than going through the courts and serving jail time.

We are so disconnected with nature and so into our electronic devices have we forgotten that humans move in and take away their homes, we take more than we need and are extremely wasteful as an intelligent species. Regarding disease, animals are not the only species that carry disease humans can carry lethal germs.

I applaud the media for making this a news item. All the home owner need to do is call the wildlife services to move the family of raccoons. I have raccoons on my property, but I live in a rural area. I let them and other wild animals live like they normally would if I did not exist in this location. I do not bother them and they have never bothered me. Humans are not the only living things on the planet and we should learn to respect that. As for the homeowner and his shovel, he is intelligent enough to know the laws; he made a mistake and will be dealt with.

The money spent on following these charges could have provided good education for a child for a couple of years somewhere in Africa. Racoons are pests afterall. I'm sure the animal lovers out there are out to get this guy. Perhaps they'd also be willing to trap and then take care of these pests on their own. Don't even think about taking them out of the city to release them. That just moves the problem and now causes crop damage and issues for farmers. You do realize that we "farmers" shoot all the animals that are dropped off in the country? Oue town is surrounded by ocean on three sides and has huge trees that support the raccoon life cycle.The furry rat b#stards would rather dig through the buffet of garbage cans put out each week for pick-up.They are brazen and unafraid of humans and dogs and anything else that lives in our area. And they love the sunshine and are out almost any time of day. The cost for repairing the damage they do every year is very high. One common saga is having to wait out the maturation of babies every Spring before the damages can be repaired.Raccoons are pests and should be exterminated just like any other vermin that does damage and threatens the safety of humans. It seems so stupid to allow them to run wild and free at
the expense of homeowners.

So PLEASE tell me what does a homeower do ??? it is illegal to discharge a firearm in Toronto, and that includes archery....he can not poison the animal, he can only live trap the animal and transport id out of the city for release. FORGET about hiring one of those licenced pest control companies to take care of your problem.....they only take the animal around the corner and release it......so they can catch it again and charge you another $200....think they are in it for you ???

Using young cuddly raccoon picture here to invoke sympathy is akin to using young cuddly bear picture and telling the readers that bears are harmless. Typical mass media manipulation.

Noisy neighbour + nanny state policies + over zealous police = man charged for trying to get of some pest in his back yard.

Now he has to empty his retirement savings on a bloodsucker so that he doesn't get thrown into jail, FOR NOTHING.

Our tax dollar well spent...

The real crime here is the attack on the idea of private property and on the well being of the middle class. Raccoons harm a lot of people and some kids that have been bitten by them have become very ill.
