TORONTO The Crown is pursuing lighter charges than it could potentially seek against a Toronto man who allegedly beat a family of raccoons in his backyard.
Dong Nguyen faces charges of animal cruelty and possession of a weapon for a dangerous purpose in connection with an alleged attack on the raccoons in the garden of his west-end home last month.
Crown lawyers told court today they are choosing to move forward with the charges as summary offences rather than indictable charges.
Indictable offences would allow for greater punishment, including a maximum sentence of up to 10 years for the weapon charge.
Nguyen, 53, could serve a sentence of no more than two years if convicted of animal cruelty.
His next court date is set for Aug. 18. Nguyen did not appear in court today.
Police were called early on the morning of June 1 after neighbours awoke to the sounds of a man allegedly attacking a family of raccoons with a shovel.
Animal services says one baby raccoon suffered some broken toes and was taken to a wildlife rehabilitation centre to recover.
Police don't know what happened to the other babies because the mother raccoon took them away.

It is about time - as a grandparent I have watched our kids (who were allowed to fail although I do remember some nagging on our part) learn, I have watched our children now micro-manage their children. A big part of it is the fact that there are predators out there and an extreme reluctance on the parents part to alllow freedom that might result in the children becoming victims.

There are animals everywhere in the world, city or countryside, if you dont like it, get over yourself. Yes coons and squirrels are pests but they are living animals too and have every right to life that you do. Humans are bigger pests than anything. I hope someone beats his head in with a shovel... he'd know how it feels. The human race is terrible and selfish. The world doesnt revolve around YOU.

As much as this individual has to face the law, the law has yet to face the real test which is "pests" revisiting property and damaging it.

On the other hand, we purchase these homes and are solely responsible for the maintenance and costly repairs from the damage done by the very same species we blasted out of their natural homes.
I don't agree with forced relocation of any species, regardless of where they are in the food chain. And I don't want to pay hundreds to thousands of dollars in repairs to my home and investment either. I can see both sides of the equation but this one argument that will be split right down the middle.

And I sure as heck wouldn't pay a trapper $200 to catch and release it around the corner so that it makes its way back again...
Want a humane way of resolving the problem? How abut legalizing the discharge of my 12gauge for pest control! I'd charge for ammunition only.

This man had intention to end a life so why should he face a lesser punishment? It happens so much more often lately and it's disgusting (talking about lesser punishments for crimes committed in general)!
Something has to be done to send a message to other animal abusers to tell them that this is wrong and unacceptable!
Raccoons are attracted to garbage - clean up your trash and you won't have a raccoon issue!

i did put my brain in gear. i work hard for my money and i plant a garden to help keep our grocery bill down and if a raccoon statrs eating at my investment i will do what ever it takes to rid of them.

How about police to give fines for driver hitting the racoons with their cars ? Maybe the car can be considered a weapon too...

Urban racoons are fearless and can be really quite mean. He did his neighbours a service by getting rid of those nusance animals.

As for the ridiculous comments about 'the right to protect MY property', did you buy it from the animals that were living there before you? Now if the previous 'human' owner of the property is loitering and digging up your garden, go ahead you have my permission to deal with him as you see fit.

These crazy rules about not moving it beyond a certain distance like out of the city is ridiculous they shouldn't live in such huge numbers inside the city. They need "population control", and the farmer's comment is right, it's solved with a .22 beyond the GTA boarder.

Hmm, if instead of raccoons, he had been accused of trying to kill a family's pet dog or pet cat (they can be just as destructive in the garden), would there be so much support for this person? I doubt it, I seriously doubt it.

Dong Nguyen is also a victim of the city responsibility in term of controlling these annoying animals which damaging the plans and properties. Hope he is not got the disease from racoons.

I applaud the media for making this a news item. All the home owner need to do is call the wildlife services to move the family of raccoons. I have raccoons on my property, but I live in a rural area. I let them and other wild animals live like they normally would if I did not exist in this location. I do not bother them and they have never bothered me. Humans are not the only living things on the planet and we should learn to respect that. As for the homeowner and his shovel, he is intelligent enough to know the laws; he made a mistake and will be dealt with.

Noisy neighbour + nanny state policies + over zealous police = man charged for trying to get of some pest in his back yard.
Now he has to empty his retirement savings on a bloodsucker so that he doesn't get thrown into jail, FOR NOTHING.
