A Thai cargo ship believed to be carrying some 200 Tamil migrants from Sri Lanka is nearing the British Columbia coast.

Public Safety Minister Vic Toews confirmed Wednesday night that the MV Sun Sea is already within the exclusive economic zone that extends 320-kilometres from the Canadian coast.

"We've been tracking this very closely. We are aware that this boat is coming into Canadian waters," Toews told CTV News Channel, adding that he could not offer many more details "because of the sensitivity of the operation."

The MV Sun Sea is expected to pass into Canadian territorial waters - defined as the area 22 kilometres from the coast - sometime Thursday.

Once it crosses the territorial boundary, the RCMP and Canadian Border Service Agency officials can board and inspect the boat, its cargo and passengers.

"The first part of the initiative would be to determine what the facts are," Toews explained. That includes identifying any issues of criminal or refugee status.

The immigrants are then expected to be taken to two specially-prepared correctional facilities in Maple Ridge, east of Vancouver.

Mystery ship's three-month cruise

Details surrounding the MV Sun Sea are scarce, as every government agency connected to the ship's arrival is referring questions to the Department of Foreign Affairs which has refused to provide even the most basic information about the vessel or its whereabouts.

Controversy has surrounded the MV Sun Sea since it set sail from Thailand last May. The ship was spotted off the coast of Guatemala in July. Later that month, the United States Coast Guard confirmed the vessel was flying a Thai flag and heading toward B.C.

"Canada now knows that it has become a target for international people smugglers…and in this case, they believe that the trafficking is being done by the Tamil Tigers," Oliver said, adding that Ottawa intends to "send a message that this simply won't be tolerated."

"In particular, the government knows that at least two other ships are waiting to come to Canada if this one gets in and everyone is accepted as a refugee as the last one was."

Ten months ago, the Ocean Lady arrived on the B.C. coast with 76 Sri Lankan migrants aboard.

An Immigration and Refugee Board spokesperson recently confirmed that all 76 people have since been released as their refugee claims are processed.

While some critics have suggested that such ships should be turned back at sea, the founding publisher of Canadian Immigrant magazine says they deserve the benefit of due process.

"Let's not start judging people before they've even landed on our shores for God's sake," Nick Noorani told CTV's Canada AM in an interview from Vancouver on Wednesday morning.

"Canada is known as a compassionate country and I believe compassion also dictates that we follow the due process of law before tagging people as terrorists," he said.

As a signatory to the United Nations Convention on Refugees, Canada is legally obligated to weigh the claims of anyone in the country claiming refugee status.

While there have been reports the MV Sun Sea is carrying high-ranking members of the Liberation Tigers of Tamil Eelam, Canadian officials have refused to speculate on who may be on the cargo ship.

"We have some idea of who is on board," Toews acknowledged Wednesday. "Without getting into operational details, we are well aware of potential issues that may arise when this boat enters our territorial waters."

"We will not allow Canada to become an easy target for people who prey on people through human smuggling or human trafficking," Toews added.

In 2006, Canada declared the Tigers a terrorist organization, making it illegal to fundraise for the group.

The Tamil Tigers were defeated by the Sri Lankan army in May 2009, after more than two decades of civil war.

When they reach our waters have our coast guard go out and greet them. At this point they can tell the ship to turn around and go back to where they came from. If they want to come to Canada through normal channels then that's o.k. This makes me angry that our government allows these people to take advantage of our system.

If there are refugees on this boat (by the hundreds!), then seize this ship and sell it on the open international market to assist in paying for the claims process and inevitable payments that get poured down their throats. By the way, a few years ago The Netherlands started to make their refugee detention centers not unlike prisons: they could stay living in Spartan conditions for as long as their claim was being processed (often, a VERY long time, plus - they can't go underground and disappear), OR they could simply ask to be escorted / sent home. As servere boredom kicks in after severa weeks, many simply ask to go back home again.

There are billions of people who are living in conditions similar to those in Sri Lanka. If we are going to let everybody in who hops on a boat with a good sob story, then we will cease to be Canada. We have laws and a process to immigrate or make a refugee claim. If you don't want to follow it, don't expect me to believe that you are some future law-abiding, hard-working citizen. If the Canadian government is going to let this boat land, then my choice is clear: get my own boat and I will fill it up with truly innocent refugees from Sudan, Burma, Tibet, etc. and sail it to Canada. I personally think that they should be allowed because, they are being killed, tortured, etc., in there country. It's not even their country, it's ruled by the Sinhalese government so they take advantage of that and enslave them. Right now the Tamils are coming to us for help because, they really need it. Mahinda Rajapakshe and some former Sinhala rulers have been torturing Tamils for all these years but, this year is even more serious because they killed more than the average amount of people being killed. The people abord the ship are trying to enter the Canada because of the problems in their country. Thery are trying to escape the war and torture of living as tamils in Sri Lanka. I have recently been to Sri Lanka and the situation has changed dramatically since the war ended last year. It is fairly peaceful there. The military presence is there at most places, but not many are even carrying their weapons anymore! I am thinking of going back to live there in a few years. Perhaps these are financial migrants?

in the early part of WWII boats full of jewish people from germany, holland, and other countries came to canada on boats and were turned around. In the end they were forced to go back to where they came from. 3/4 of the people on the boats who were turned around died in concentration camps.The people on these boats deserve the chance to make a new better life, they can be skilled labourers or even more. Do not send them back, take them in help them. interrogate them to ensure they are not terrorists. instead of paying for their care, help them find jobs and pay employers for helping out. I can't imagine living in some of these countries, living in fear, fearing for your children, deplorable living conditions. Firstly confiscate the ship and sell it for scrap , then ship owners will be slow to provide vessels.Then provide these illegals with Canadian entry application forms , put them on a plane and send them back to apply legally. @Sara: no one is knocking legal immigration. In this case refugees are not legal immigration of skilled people needed to advance this country. If they want to land here legally, they should be applying and qualify like everyone else who are in line waiting for their residence. A boat load of stowaways is not the way here. I just hope that the canadian immigration turns the boat back or send it on, or we have to spend more money to keep them here for processing.

All the government has to do is tell the Coast Guard not to let the vessel enter Canadian waters. The lower west coast of Vancouver Island and Juan de Fuca Strait are under US/Canadian radar surveillance 24/7. The vessel is required to participate in the vessel traffic scheme and part of that is getting permission to enter Juan de Fuca Strait. Large unidentified contacts are investigated by aircraft. The traffic regulator just has to say "MV Sun Sea is not authorized to enter Juan de Fuca Strait and by order of the Minister is directed to leave the approaches and Canadian territorial waters immediately". The ship may continue on, but on entering Juan de Fuca, they will be in waters for which the US has traffic jurisdiction, including the Canadian side of the Strait. The US Coast Guard is a military organization, and they take a dim view of non-compliant vessels. If we tell them the ship was denied entry but proceeded anyway, they will take care of it for us. I wouldn't be surprised to see a destroyer off Neah Bay. They still have a lot of unresolved anger issues around 9/11 and the Strait will be boiling with fast, armed boats and naval vessels before you know it.

We have enough arrive without proper checks done before they arrive as it is. We should be sure they won't be a danger to our society and are not criminals before allowing them refugee status.

Hmm- Not entering country by legal means and no known backgroung on occupants of ship. IF they are allowed in Canadian waters it is a travesty of our legal system. Keep them in international waters and let the ships owner deal with the situation in the proper manner. C'mon government -stand up for decent law abiding citizens!

Have some heart people! Put yourself in their shoes. If you were in a war torn country and had the chance for a better life elsewhere, wouldn't you take the opportunity? Applying through the immigration system is a slow process and you could be dead by then. It doesn't matter if they are Tamil or not. There's no difference between Canada taking refugees from Sri Lanka or from other war torn countries like Vietnam or Iraq, for instance. Remember, 99% of us are immigrants to north america at some time or another through our families.

I am sure many of you who have made a comment about refugee's coming here to use our welfare system, truly have no clue about what you are talking about. For your information, many of them obtain a work permit and begin to work in our society as soon as they obtain it. Therefore helping our economy and paying taxes like you and me. Others who dont speak English attend school to learn english so that they can begin to work, as soon as possible. If any of you need more Information go to the CIC website and get informed before making such judgemental comments. Wow lots of high and mighty people today. Don't forget we are all immigrants. Canada does not have the abillity to maintain it's population without immigration. I am 4th generation Canadian, but my great grandparents came here on a boat from Ireland too. And at that time there were a lot of so called "Canadians" that did not want the Irish to come here either. Personally I believe that immigration is as Canadian as it gets.

If Canada was in the state that Sri Lanka is in, I would want the Sri Lankan people to do the moral thing and help me and my family out. Desperate times call for desperate measures and I would totally board a ship to get to another country in order to make my family safe.Also, Canada has a terrible birth rate and without immigrants we would be loosing population every year. We need immigration to keep our country running. No one ever said that the refugees would be on welfare or 'scabs on society'. The majority of immigrants, refugees or otherwise, contribute more to our country than some people born here do.I have no problem welcoming refugees into Canada. If our government knows they are not 'terrorists' bent on killing people, but families fleeing from violence and persecution in their home countries, then I would gladly receive them. I'm proud to be from a country that would knowingly receive refugees of war and violence and while also keep its citizens safe of those coming to spread violence.What would happen if my home was invaded and people with guns were terrorizing my family and committing terrible acts of violence? What if I ran with them next door to your house to get help and call the police? Would you turn me away too? Would you force me and my children back into that house to face it? I trust our government and that they will weed out those who are not legitimately here for refuge. I mean no harm, and I'm sure these families don't either.

I am a firm believer in immigration - there is nothing wrong on being a dream for people subjugated and oppressed in their own lands. However, we do have a legal framework to follow. I sponsored my wife when she came to Canada, and we had to be so careful during the process. The mountain of administration we supplied had to be perfect and the fees had to be paid immediately. It is quite maddening that the steps we went through are thrown away because of the perception it would be irresponsible to turn the ship away.

Whether they have valid claims or not Canada should take a firm stand regarding these types of mass landings. They definitely should be held in custody for processing and those without valid claims should be sent back immediately however the state of the immigrant lobby and the many levels of appeal prevents this from happening swiftly.

Most have probably already gone underground.Why do we continue to let ourselves and our society be abused by these people.Australia has the right idea. Anyone else notice that the Liberals and the NDP have nothing to say about this major story? Instead the Liberals are treating the census debate as it's the top priority. Why shouldn't they ignore this? After all, the Liberals cater to the immigrant community for votes and thus keep quiet on this. Everyone who are concerns about social assistance to these people should also think about the Tamils who are now contributing back to Canadian society. Yes, at some point almost all of them were supported by the social assistance but now they are contributing greatly to this country. Why only look at the one side of the coin when you call clearly see Tamil community's growth and contribution to this society in last 20 years. Remember at some point in our history all of our ancestors did came into Canada in same fashion. God bless all the double standards and narrow minded views.

I am simply furious at the lack of this country to take tough action. We have to turn this ship around before they even enter Canadian waters.This is not the 1st. time we have seen this illegal entry into Canada from the Tamils and my bet is, it won"t be their last. Its time to get rid of dual citizenship in Canada. If people had to renounce their countries citizenship and become a full Canadian maybe it would make a few people stop and think before they immigrated. Most immigrants are hard working people who just want a better life and embrace our values. ( Most Canadians are children of immigrants ) Unfortunately we are currently dealing with a new group of immigrants who have values that are counterproductive to the Canadian values of freedom and justice. Many women in this country find the burca extremely offensive because of its representation of female oppression. Women have fought for years to be respected in this country and will not tolerate any group coming here that believes that we are third class citizens. WE have to take a stand and protect the rights and freedoms that this country is known for and that people have died for.

I think Canada has been very generous to refugees in the past. Most escaping war in their own countty to come here. We should continue to be generous and compansionate. but on the look out for those trying to skip the process or filing bogus claims to enter. We have had more than our share of these immigrants who come here, break the law and then flee and we can't find them, When we do it takes years to get them out. They should be allowed in and based on their merits while they are here so on a trial basis only.

Why the hell we are accepting more and more illegal migrants. Aren’t we having enough poverty in our country, go on streets of big cities like Toronto, Vancouver, Montreal to see homeless people, why we don't provide shelter to them. I'm fine with accepting them on one condition, and one only, which is that the bleeding hearts willing them into the country accept criminal responsibility for any acts any of them commit. Otherwise, turn the boat away. Legitimate refugees are one thing, but there is a process, and we have a lot of folks who will come and contribute to Canada by following that process. It may not be the most humanitarian attitude, but like other posters, this is not a way to spend my tax dollars when the risk is high.

We have to be fair to all refugees in the world, no one should be allowed to jump the queue. There must be many other ways to help them immigrate into Canada while at the same time not to over-burden our existing society. (like re-allocate quotas, establishing sponsorship funds...).We helped the "Boat People" in the past, but we must decide if the circumstances are similar.

While these people have not even arrived on our shores yet, I believe the Canadian authorities are taking the correct approach. Detain them, ascertain their identities as best as possible and make individual decisions about each refugee claim based on the individual. If there is any doubt as to the identity of any one person or their backgroun(ie, terrorist but lets not forget the old axiom - one man's terrorist is another man's legitimate and oppressed freedom fighter), then send them back to their own country. If it can be determined that their lives are truly in danger by sending them home, then a hard decision will have to be made by Canadian Immigration authorities. I for one am tired of refugees living off the taxpayer's back. Get a job, get productive and become Canadian...fine. Otherwise go home.

Abosolutely no surprise that the Tamil community would support these people coming to Canada through the back door. Meanwhile immigrants legally wait for years to enter this country. Imagine how frustrated they must be when they see the queue jumpers get in. Now queue the immigration lawyers!

Why should we not judge them before they land? They are coming here in an attempt, presumably, to stay in this country. Most likely, they don't have the paperwork or permission to do so. If they did, the gov't would have said they did and this would be a non-issue. Further, it is more than likely that there are rebels on this ship because they are the ones who have the cash to do so and hide more easily. I believe we should send all of them back to the country of origin. I love Australia's vision for this kind of act. They will let you stay if they need you and if you follow their rules of conduct. If not, it's bye-bye. What is wrong with that? It's not racism or any other bleeding heart issue. It's our country and we should expect people to come here and be productive and follow our rules and way of life.

Tolerance is one thing - abuse of process is another! What about the ship that is carrying these people? Who paid the ship owners'? What I would like to see is: (1) if the ship is indeed carrying would be refugees then the ship should be escorted out of Canadian waters and told to go elsewhere, or (2) that the ship be seized and the ship owners' fined millions of dollars and only when paid would the ship be released.I have nothing against the Sri Lankan people. What does concern me is when people in large numbers arrive on our shores, claiming refugee status and then end up collecting social services which if I am correct, is more than our senior citizens (who worked and paid taxes most of their lives) make. I am starting to believe the Danes have the right idea.
